Der Begriff des Arbeitnehmers ist im Gesetz jedoch nicht genau definiert, sodass hierfür auf allgemeine arbeitsrechtliche Grundsätze, insbesondere der Rechtsprechung des Bundesarbeitsgerichts zurückgegriffen wird. Hiernach werden als Arbeitnehmer diejenigen bezeichnet, welche im Rahmen einer von Dritten bestimmten Arbeitsorganisation und in persönlicher Abhängigkeit Dienstleistungen erbringen. Dabei ist nicht relevant, wie Vertragsinhalte formuliert sind, sondern vielmehr die tatsächliche Durchführung der Vertragsinhalte. I.2 Betriebsbezug Für den Geltungsbereich des Kündigungsschutzgesetzes kommen Betriebe, Unternehmen und Konzerne in Betracht; auch wenn letztere nicht namentlich erwähnt werden. Für Kleinbetriebe gilt das Kündigungsschutzgesetz allerdings nicht. Unter einem "Kleinbetrieb" versteht man nach aktuellem Recht gemäß § 23 KSchG Betriebe und Verwaltungen, die in der Regel weniger als zehn Arbeitnehmer beschäftigen. Damit wird den Kleinbetrieben ein Privileg eingeräumt, da diese weniger leistungsfähig sind und größere Flexibilität benötigen, um Arbeitsverhältnisse zu beenden. Es greift jedoch eine Sonderregelung für Arbeitnehmer, deren Arbeitsverhältnis bereits vor dem 01.01.2004 bestanden hat. Hier gilt der alte Schwellenwert von 5 Arbeitnehmern. Dies führt dazu, dass es bei Betrieben mit 5 bis 9 Arbeitnehmern zu einer "zwei Klassen-Aufteilung" kommt. Wird ein weiterer Arbeitnehmer beschäftigt und wächst der Personalbestand dadurch auf z.B. 8 Arbeitnehmer, so greift für diesen Arbeitnehmer nicht das Kündigungsschutzgesetz.
