Ausgehend von der Feststellung, dass Umstande, die "regelmassig" im Falle der Deliktsverwirklichung mitgegeben sind oder "typischerweise" vorliegen und so das "Regeltatbild" eines Delikts verkorpern, in der Vergangenheit haufig dem Doppelverwertungsverbot unterstellt wurden, befasst sich die Arbeit im ersten Teil mit dem Umfang und den Grenzen des Doppelverwertungsverbotes, wie es in 46 Abs. 3 StGB niedergelegt ist. Die Untersuchung kommt dabei zu dem Ergebnis, dass das DVV zwar uber den Wortlaut hinaus auch solche Umstande erfasst, die "stets und notwendigerweise" mit der Tatbestandsverwirklichung einhergehen, nicht aber solche, die nur "regelmassig und typischerweise" mitverwirklicht sind. Insofern verkorpert das Doppelverwertungsverbot ein schlicht logisches Prinzip. Gleichwohl haben auch solche Umstande fur die Verwertung in der Strafzumessung auszuscheiden. Fur das andere, das "wertende" Ausschlussprinzip muss jedoch ein anderer Standort gefunden werden. Die Untersuchung geht deshalb der Frage nach, auf welcher Ebene der Strafzumessung im Sinne des Bruns'schen Funf-Phasen-Modells das "Regeltatbild" seinen Platz haben konnte. Er wird in der 3. Phase (oder Stufe) der Strafzumessung gefunden, wo es um die Festlegung der sogenannten Bewertungsrichtung von Strafzumessungstatsachen geht, in der um die Festlegung eines Ausgangspunktes, von dem aus gemessen wird, nicht umhinzukommen ist. Die Arbeit versucht den Nachweis, dass beide Prinzipien nicht ohne einander auskommen und sich auch anderswo sinnvoll erganzen. Der zweite Teil widmet sich deshalb der Lehre von der Gesetzeseinheit oder "Gesetzeskonkurrenz", wo sie in der Spezialitat einerseits und der Konsumtion andererseits seit langem Ausdruck finden. Die Untersuchung schliesst mit der Erkenntnis, dass auch das Wesen der Gesetzeseinheit noch immer nicht richtig verstanden ist, wenn angenommen wird, auch das verdrangte Gesetz konne Einfluss auf die Strafzumessung nehmen. Im Falle der Spezialitat folgt dies, wie vielfach bereits anerkannt, aus dem Doppelverwertungsverbot, im Falle der Konsumtion widerspricht die Berucksichtigung dem dargelegten "Regeltatbildprinzip".
