Richtlinien der Europäischen Gemeinschaft sind in der Gesetzgebung zu berücksichtigen und müssen bei der Gesetzesauslegung beachtet werden, wenn ein Gesetz auf einem europarechtlichen Hintergrund basiert. Die Rechtsprechung des EuGH hat eine enorme Bedeutung erlangt, die bis zur - allerdings umstrittenen - Normverwerfung nationalen Rechts in der Rechtssache Mangold geht. Ein in der aktuellen Diskussion besonders stark in den Mittelpunkt gerücktes Thema ist in diesem Kontext das noch relativ neue Gebiet des Antidiskriminierungsrechts. Zu den dazu erlassenen Richtlinien gehört die Richtlinie 2000/78/EG, welche unter anderem die Diskriminierung wegen des Alters verbietet. Die europarechtlich gebotene Umsetzung in nationales Recht erfolgte durch das am 18. 8. 2006 in Kraft getretene Allgemeine Gleichbehandlungsgesetz. Dieses Gesetz sah sich wegen zahlreicher Unzulänglichkeiten von Anfang an der Kritik im Schrifttum ausgesetzt und wurde bereits kurz nach Inkrafttreten korrigiert. Während das Gesetz in einigen Punkten über die gemeinschaftsrechtlich gebotene Umsetzung hinausgeht, wird andererseits eine Unterschreitung des gebotenen Diskriminierungsschutzes gerügt. Exemplarisch sei diesbezüglich nur auf die Diskussion über die mögliche Europarechtswidrigkeit der Herausnahme des Kündigungsschutzes aus dem Anwendungsbereich des AGG durch § 2 Abs. 4 AGG verwiesen. Innerhalb des Antidiskriminierungsrechts spielt wiederum die Diskriminierung wegen des Merkmals "Alter" eine besondere Rolle, so dass diese Problematik nicht nur aktuell, sondern auch noch in näherer Zukunft eines der beherrschenden Themen im Arbeitsrecht sein wird.
