Thomas Hobbes war der erste Philosoph und Staatstheoretiker, welcher einen Gesellschaftsvertrag zur Begründung eines geordneten Staates vorschlug (Schmidt 2009: 33). Sein allumfassendes Werk "Leviathan oder Stoff, Form und Gewalt eines kirchlichen und bürgerlichen Staates", welches im Jahre 1651 veröffentlicht wurde, beginnt mit Beschreibungen über den Menschen (Teil 1: Vom Menschen), bevor er in einem zweiten Teil über den Staat (Teil 2: Vom Staat) schreibt. In der vorliegenden Hausarbeit ist ausschließlich der erste Teil (Vom Menschen) von Bedeutung. Hobbes meint, dass zur Schaffung eines geordneten Staates eine externe Instanz von Nöten ist, welche Gesetze erlässt und auf welche sich die Menschen vorher geeinigt haben müssen (Hobbes 1966: 97). Die entscheidende, zugrundeliegende Fragestellung der vorliegenden Hausarbeit beschäftigt sich damit, warum es der Mensch von sich aus nicht schafft, den Naturzustand zu überwinden und somit einen geordneten Staat zu formen und daraufhin zu legitimieren? Warum hält sich der Mensch nicht an die formulierten natürlichen Gesetze, welche Hobbes in Kapitel 14 und 15 als Regeln der Vernunft bzw. als moralische Vorschriften beschreibt? Warum benötigt der Mensch zur Schaffung eines geordneten Staates wie beschrieben eine externe Instanz in der Form eines Staatsoberhauptes? Dieses Problem wird versucht anhand des aus der Spieltheorie stammenden Gefangenendilemmas zu analysieren und zu erklären. Dabei werden die empirischen und normativen Bedingungen des Naturzustands mit dem Gedankenexperiment des Gefangenendilemmas in Bezug gesetzt.
