English summary: Bernhard Ulrici deals with the fundamental questions of employees' copyright in property law: licenses and claims to remuneration. In doing so, his main objective is to establish basic abstract principles to resolve these issues. The author explains that the employer is permitted to utilize the work done in his interest in conformity with the purposes of the contract. Since the employee has created the work at the risk of the employer, he is basically not entitled to any particular remuneration for the granting of licenses within the scope of the risk taken. German description: Die zentrale Vorschrift uber urheberisches Schaffen im Arbeitsverhaltnis ( 43 UrhG) enthalt keine Aussage uber die hiermit verbundenen wirtschaftlich bedeutsamen, vermogensrechtlichen Grundfragen: Welche Nutzungsrechte stehen dem Arbeitgeber zu? Welche Vergutung kann der Arbeitnehmer beanspruchen?Bernhard Ulrici zeigt auf, dass es fur beide Fragen ohne Bedeutung ist, dass das Urheberrecht originar in der Person des Arbeitnehmers entsteht, wenn er ein Werk schafft. Dieser Unterschied gegenuber der vor allem im Bereich des 950 BGB bestehenden Rechtslage ist durch den personlichkeitsrechtlichen Einschlag des Urheberrechts bedingt. Eine vermogensrechtliche Wertung ist ihm nicht zu entnehmen.Der Autor veranschaulicht, dass der Arbeitnehmer auf Grund des fremdnutzigen Charakters des Arbeitsverhaltnisses dem Arbeitgeber an den von ihm geschaffenen Werken insoweit Nutzungsrechte einraumen muss, als dieser hierauf angewiesen ist, um die zum Werk fuhrende Arbeitsleistung vertragszweckkonform zu nutzen.Da der Arbeitnehmer das Werk auf wirtschaftliches Risiko des Arbeitgebers schafft, steht ihm ohne besondere Abreden im Umfang dieser Risikoubernahme keine gesonderte Vergutung fur die Einraumung von Nutzungsrechten zu. Abweichendes folgt auch nicht aus 32 UrhG, der nicht berucksichtigt, dass der Arbeitgeber im Unterschied zu anderen Werknutzern neben dem Verwertungsrisiko auch das Entstehensrisiko tragt. Besondere Vergutungsanspruche konnen sich allerdings aus 32a UrhG ergeben, der einer Eigenart geistiger Werke Rechnung tragt.
