English summary: Today, the internet is an important marketplace for transactions of goods and services. However, e-commerce involves specific legal risks for the purchaser. The European legislator, and therefore the European member states as well, try to protect the consumers by numerous new statutes, which indeed were constructed without considering the specific economic mechanisms of the internet, the so-called network economy. Wolfgang Seiler compiles and discusses the European and German consumer protection law for the internet in the context of network economy and examines the need for amendments. German description: Die gesetzlichen Vorschriften zum Schutz des Verbrauchers im Internethandel werden immer differenzierter und unubersichtlicher. Bislang fehlen Untersuchungen, die dieses Rechtsgebiet theoretisch aufbereiten, auf seine okonomischen Grundlagen beziehen und die Implikationen fur die praktische Ausgestaltung von Verbraucherschutzrecht naher beleuchten. Wolfgang Seiler geht von der Erkenntnis aus, dass sich Theorie und normative Ausgestaltung einiger Rechtsgebiete, zu denen auch das Verbraucherprivatrecht gehort, im engen Anschluss an die herkommliche Wirtschaftstheorie und damit parallel zum herrschenden Markt- und Wettbewerbsmodell entwickelt haben. Offizielle Verbraucherpolitik ist dementsprechend vor allem allgemeine Wettbewerbspolitik, Verbraucherprivatrecht ist vor allem Wettbewerbs- und Kartellrecht. Mit dem Entstehen elektronischer, vernetzter Markte, wie sie insbesondere im Internet vorkommen, wird jedoch auch die Frage nach Dysfunktionalitaten des traditionellen verbraucherrechtlichen Gestaltungsparadigmas virulent, da die Gesetzmassigkeiten der neoklassischen Wirtschaftstheorie auf elektronischen Markten nicht mehr unverandert wirksam sind. Vielmehr gelten hier neue, abweichende Regeln, die in den Wirtschaftswissenschaften unter der Bezeichnung 'Internet-Okonomie' diskutiert werden. Indessen wurden diese bei der Regelung des Internet-Verbraucherprivatrechts vom Gesetzgeber nicht berucksichtigt. Der Autor geht den theoretisch wie praktisch relevanten Fragen nach, wie die Internet-Okonomie die Rolle des Verbrauchers auf dem Markt verandert und ob vor diesem Hintergrund Novellierungsbedarf fur das Internet-Verbraucherprivatrecht besteht.
