Studienarbeit aus dem Jahr 2015 im Fachbereich Jura - Zivilrecht / Arbeitsrecht, Note: 1,3, Universität Kassel, Sprache: Deutsch, Abstract: Wieder einmal hat eine Norm des deutschen Arbeitsrechts Rechtsgeschichte geschrieben. Mit § 14 Abs. 3 TzBfG sollte der Abschluss befristeter Arbeitsverträge für ältere Arbeitnehmer erleichtert werden und somit die Beschäftigung älterer, arbeitsloser Arbeitnehmer gefördert werden. Nach dieser Norm bedurfte die Befristung eines Arbeitsverhältnisses keines sachlichen Grundes, wenn der Arbeitnehmer das 58. Lebensjahr vollendet hat. Somit konnten Arbeitsverträge mit älteren Arbeitnehmern ohne Beachtung von Anzahl und Dauer der Befristungen abgeschlossen werden. Einzige Voraussetzung hierfür war nur, dass der Arbeitnehmer ein bestimmtes Mindestalter erreicht hatte. Diese Norm wurde vom deutschen Gesetzgeber überzogen ausgestaltet und es wurde mit ihr auch nicht der gewünschte Erfolg erzielt. Befristete Arbeitsverhältnisse haben sich nicht als Lösung des Beschäftigungsproblems herausgestellt. Im Jahr 2000 lag die Anzahl befristeter Arbeitsverhältnisse bei etwa 2,744 Mio. und im Jahr 2004 bei 2,478 Mio. Die Quote ist also um etwa acht Prozent gesunken. Das beschäftigungspolitische Ziel von § 14 Abs. 3 TzBfG ist somit nicht erreicht worden. Schon als die Norm verabschiedet wurde, kamen erhebliche europarechtliche Bedenken auf. Den deutschen Gesetzgeber ließ dies allerdings unberührt obwohl es mehrere Möglichkeiten zur europarechtskonformen Korrektur der Norm gab. Da die Norm aber im deutschen Arbeitsrecht so selten genutzt wurde, bedurfte es eines konstruierten Falles, um diese Frage dem EuGH vorzulegen. Genau diese Fiktivität des Rechtstreits ließ nach dem Urteil des EuGH viel Spielraum für Kritik. Das Mangold Urteil hat ein erhebliches Aufsehen erregt und bereits ein Jahr nach dem Urteil gab es eine außergewöhnlich große Zahl an Anmerkungen und Kommentaren.
