C'est certainement l'oeuvre la plus importante de Tertullien, écrite en l'an 197 et adressée aux souverains de l'Empire romain. Tertullien est né à Carthage en 155 après J.-C. et y a exercé sa profession d'avocat quand, en 193, il s'est converti au christianisme et a commencé à travailler comme catéchiste avec l'Église.Son intelligence et sa solide formation juridique ont été clairement démontrées dans cet ouvrage, dans lequel il défend les chrétiens, en faisant appel à leur droit à la liberté religieuse, devant le cruel et persécuteur Empire romain. Ses arguments sont exposés de manière logique et polémique, visant à convaincre les autorités auxquelles il s'adresse, à remettre en cause la "justice" appliquée contre les chrétiens, à transporter l'apologétique du terrain philosophique au terrain juridique.Avec une habileté admirable, Tertullien censure les procédures légales en vigueur du pouvoir d'État "païen" contre les chrétiens: le crime de "nomem christianum" (= "nom chrétien") suffit à entraîner la condamnation. Tous les criminels ont le droit de se défendre, mais pas les chrétiens. Pour eux, la torture tente d'obtenir une confession; pour les chrétiens, une apostasie. Les méchants soupçons se répandent contre les chrétiens, Tertullien les repousse comme des mensonges, exposant en opposition l'essentiel concernant la foi chrétienne et la vie des communautés. En conclusion, il déclare que le christianisme est une philosophie; mais les philosophes païens ne sont pas obligés, comme les chrétiens, de sacrifier et peuvent même renier les dieux en toute impunité. Cependant, les cruautés des païens ne feront pas de mal aux chrétiens; au contraire, "le sang des chrétiens est comme une graine qui germe" ()."Rarement un discours de défense chrétien a connu une telle précision d'arguments juridiques, une telle rudesse d'ironie, une telle rigueur de logique, où les arguments sont donnés comme des coups droits, des formules martelées, des dilemmes incontournables, sans concessions à la position des pouvoirs publics ou des philosophes. Pour lui [Tertullien], il ne suffit pas de convaincre son adversaire: il l'écrase, lui marche dessus, l'humilie.
