English summary: Jochen Lux studies the legal elements of general market obstruction, which was developed in the 30s based on the blanket clause of the fair trading law in the court rulings of the Supreme Court of the German Reich and which has been one of the most controversial subjects in the fair trading law since then. Within the context of the extensive reform of the fair trading law in 2004, the lawmakers did include a comprehensive list of examples in the law in order to explain the new blanket clause of paragraph 3 of the Unfair Competition Act; however, cases of general market obstruction were not included explicitly as part of the law. Making use of the insight gained in the theory of competition, the author shows that it would be logical to abandon the legal elements of general market obstruction. German description: Jochen Lux untersucht den Tatbestand der allgemeinen Marktbehinderung, der seit jeher zu den umstrittensten Materien des Lauterkeitsrechts gehort. Die Fallgruppe beruhrt insoweit Grundfragen des Wettbewerbsrechts, wie den Schutzzweck des UWG, die Konkretisierung der Generalklausel sowie das Verhaltnis von UWG und GWB. Wurde vom Reichsgericht zunachst die massenweise unentgeltliche Verteilung von Schuhcreme oder Waschpulver beleuchtet, stehen heute Preisunterbietungen sowie die Gratisverteilung von Presseerzeugnissen im Blickpunkt der lauterkeitsrechtlichen Rechtsprechung. Mit dem Tatbestand der allgemeinen Marktbehinderung wird dem UWG uber die blosse Marktverhaltenskontrolle hinaus die zusatzliche Aufgabe einer Marktstrukturkontrolle zugewiesen. Zwangslaufig ergeben sich insoweit Beruhrungen, wenn nicht gar Uberschneidungen mit den Missbrauchstatbestanden des GWB. Unter dem Gesichtspunkt der allgemeinen Marktbehinderung kann ein bedenkliches Wettbewerbsverhalten unterbunden werden, wenn es allein oder in Verbindung mit gleichartigen Massnahmen von Mitbewerbern die ernstliche Gefahr begrundet, der Leistungswettbewerb werde in nicht unerheblichem Masse eingeschrankt. Ohne weiteres ersichtlich ist insoweit die Gefahr einer unnotigen Beschrankung des Wettbewerbs. Denn die richterliche Beurteilung, ob der Wettbewerbsbestand gefahrdet oder gar aufgehoben wird, setzt zwingend die Kenntnis voraus, was Wettbewerb eigentlich ist. Unter Rekurs auf die Erkenntnisse der Wettbewerbstheorie zeigt der Autor auf, dass der Tatbestand der allgemeinen Marktbehinderung konsequenterweise aufzugeben ist. So ist es in Anbetracht der bestehenden Prognose- und Irrtumsrisiken kaum zuverlassig moglich, entsprechende Beeintrachtigungen der Wettbewerbsfreiheit uberhaupt festzustellen. Auch ist die Fallgruppe vor dem Hintergrund der Wertungen des GWB nicht anzuerkennen.
