Renate Schaub analyzes sponsorship contracts and other contracts which serve a purpose beyond the contract itself, develops rules to deal with such contracts and also considers the wider legal context of these transactions, for example in competition and intellectual property law. The sponsorship agreement is characterized as a legal transaction in which the person or association sponsored performs a service of communication and in return for this receives financing or other support. German description: Sponsoring als Schlusselbegriff im Zusammenhang mit der Finanzierung sportlicher, kultureller oder sozialer Aktivitaten und zugleich als wichtiges Instrument der Unternehmenskommunikation wurde im deutschen Recht bislang nur ansatzweise erfasst. Renate Schaub stellt nach einer ausfuhrlichen Rechtstatsachenanalyse Sponsoringvertrage in den grosseren Zusammenhang von Vertragen zur Forderung uberindividueller Zwecke, analysiert und systematisiert diese Rechtsgeschafte (u.a. auch zahlreiche ganz oder teilweise unentgeltliche Geschafte, Werbevertrage, Lizenzvertrage) und entwickelt Regeln zu ihrer zivilrechtlichen Erfassung und zur Rechtsgestaltung. Schwerpunkte liegen unter anderem auf der Weiterentwicklung der Grundsatze zur Erfassung typengemischter Vertrage und zur Vermarktung personlichkeitsrechtlich gepragter Rechtspositionen. Auch die Bezuge der untersuchten Rechtsgeschafte zu anderen Rechtsgebieten, insbesondere zum Lauterkeits- und Medienrecht, werden erortert. Die Autorin konkretisiert den Typus des Sponsoringvertrags als Rechtsgeschaft, bei dem der Gesponserte eine Kommunikationsleistung erbringt und dafur vom Sponsor eine Forderleistung erhalt, als Grundlage der vertragsrechtlichen Beurteilung und differenziert nach der Interessenstruktur zwischen zwei Untertypen, die sich aus dem ubergeordneten Blickwinkel der Analyse von Vertragen zur Forderung uberindividueller Zwecke ergeben. Abschliessend arbeitet sie grundlegende vertragsrechtliche Strukturen der Forderung uberindividueller Zwecke heraus.
