INTRODUCTION The heritage of the Solar Rights Act comes from the very hard work of early pioneers. The efforts of the years of been a continuous trend to sprout a robust industry.
By all measures California has led the way in taking America solar. ABC Solar has been riding this wave since 2000. We are grateful for our business opportunities but mostly we are so very happy to see the smiles of our clients.
Flower Power sure is nice and tight. But this book is about fighting for what is right. The Solar Rights Act 2018: California Rules for Solar Energy Systems is a collection of laws, rules, regulations, decisions and cases that relate to solar.
Also included are 2017 efforts for advocacy in defense of the Solar Rights Act. This includes our Petition to Modify D.14-05-033, which was used by Southern California Edison to deny the Permission to Operate (PTO) for an ABC Solar Client. Other efforts that show possible fruit are the pursuit of SCE in small claims court for violating state law. This case has also led to test the Formal Complaint system at the CPUC.
It is my current belief that the CPUC lacks basic respect for due process. That concern is driving a much deeper inspection into these efforts than normal advocacy.
I contend that the 1999 law known as CPUC 1759 set up a system that makes the Investor Owned Utilities (IOUs) feel invincible. The feeling of being all powerful has spread to the staff at SCE and created a my way or the highway environment.
You will see specific effort to identify the denial of due-process in the Small Claims court action against SCE. Like the Rapters in Jurassic Park, I am systematically testing the fence to see where it is weak.
So far it is a strong fence and CPUC 1759 has held its power. But, the first judge in Small Claims court punted. This put strong wind back in our sails.
In the end we only have one goal, get our client solar energy system connect to the grid. This is a goal that we must not fail on.

Artifice. That really is the key word in CPUC Rules and Regulations that caught my gaw the most.
Artifice - Noun: clever or cunning devices or expedients, especially as used to trick or deceive others:
