Studienarbeit aus dem Jahr 2012 im Fachbereich Jura - Strafrecht, Note: 12/2,5, Ludwig-Maximilians-Universität München, Sprache: Deutsch, Abstract: Im deutschen Strafrecht gilt der Grundsatz der Straflosigkeit der Selbstschädigung. Betrachtet man jedoch das Betäubungsmittelstrafrecht, fällt auf, dass die Regelungen des BtMG gerade darauf abzielen, Selbstschädigung infolge Betäubungsmittelkonsums zu vermeiden. Diese Problematik lässt sich am besten an folgender Gegenüberstellung verdeutlichen: Wer beispielsweise Cannabis, Kokain oder Heroin konsumiert, muss fast in allen Ländern mit einer Bestrafung rechnen. Gefährdet hingegen jemand seine eigene Gesundheit, indem er raucht, sich ungesund ernährt oder sich sogar selbst tötet, bleibt derjenige straflos. Dieser Widerspruch mit dem Grundsatz der Straflosigkeit der Selbstschädigung führt dazu, dass das BtMG häufig Gegenstand von Diskussionen und Kritik ist. Darf der Staat den Menschen vor sich selbst schützen? Und inwieweit ist die Bestrafung des Umgangs mit Betäubungsmitteln mit der Straflosigkeit von Selbstschädigung zu vereinbaren? Umstritten ist daher, wie das strafrechtliche Verbot im BtMG zu legitimieren ist. Geht man von der Rechtsgutslehre aus, müsste durch das BtMG ein Rechtsgut geschützt werden. Diesbezüglich spalten sich die Meinungen in Rechtsprechung und Literatur. Wo das Bundesverfassungsgericht das BtMG mit dem Schutz des Rechtsguts der Volksgesundheit rechtfertigt, stellt ein Teil der Literatur auf den Schutz des Einzelnen ab. Die vorliegende Arbeit setzt sich zum einen mit der Problematik der Selbstschädigung im Strafrecht auseinander und soll Aufschluss darüber geben, ob sich die mittelbare Bestrafung des Drogenkonsums trotz des Grundsatzes der Straflosigkeit der Selbstschädigung legitimieren lässt. Zum anderen soll anhand des Cannabis-Beschlusses dargelegt werden, wie das Bundesverfassungsgericht das strafrechtliche Verbot von Drogenstraftaten begründet.
