Nos últimos anos, houve um aumento significativo da securitização de recebíveis no Brasil. Um dos fatores importantes neste sentido foi a aprovação da Lei n° 9.514, de 1997, referente ao Sistema de Financiamento Imobiliário (SFI), que institui a alienação fiduciária de coisa imóvel, sendo um instrumento positivo e de maior segurança para as instituições de crédito. A securitização de recebíveis imobiliários vem destacando-se como fonte crescente para alternativa funding para o mercado imobiliário nacional continuar se desenvolvendo e, consequentemente, cumprir o deficit e a demanda habitacional, frente ao crescimento do mercado. O objetivo geral do trabalho é apresentar um estudo sobre a evolução e o desenvolvimento da securitização de recebíveis imobiliários no Brasil e também sobre os principais agentes e os riscos envolvidos neste mecanismo, trazendo recomendações a respeito da securitização. O método utilizado para a realização do trabalho foi a pesquisa bibliográfica em livros, artigos, dissertações, documentos divulgados por empresas do setor imobiliário, relacionando-os com os principais aspectos que envolvem a securitização de recebíveis imobiliários. O resultado do trabalho evidencia que para correr mais operações de Securitização de Recebíveis Imobiliários no Brasil com um maior nível segurança, estariam a liberação de crédito consciente e a proteção adicional contra desemprego e invalidez temporária, que seriam de grande relevância para um cenário de instabilidade econômica futura. Isso possivelmente minimizaria o risco de inadimplência aos investidores destes portfólios.In recent years, there has been a significant increase in receivables securitization in Brazil. One of the important factors in this direction was the adoption of Law No. 9514 of 1997, relating to the Real Estate Financing System (SFI), establishing the lien of real estate, with a positive instrument and greater security to credit institutions. The securitization of real estate receivables is standing out as a growing source for alternative funding for the national real estate market to continue to develop and thus fulfill the deficit and housing demand, compared to market growth. The overall objective of the study is to present a study on the evolution and development of real estate receivables securitization in Brazil and also about the key players and the risks involved in this mechanism, bringing recommendations regarding securitization. The method used to carry out the work was research on books, papers, documents released by real estate companies, linking them with major aspects involving the securitization of real estate receivables. The result of the study shows that to run more operations Securitization of Real Estate Receivables in Brazil with a higher security level would be aware of the release of credit and additional protection against unemployment and temporary disability, which would be of great relevance for a scenario of future economic instability.
