And the Jurors aforesai-d upon their oath aforesaid do further present, that the said Orazio de' Attellis Santangelo further conniving, intend mg, as aforesaid, on the said twenty-sixth day of August ln_ theyear' of our Lord one thousand eight hundred and forty-two, with force and arms disc. At thafirst ward of the city and county of New York afore said of his hatred, malice and ill-will towards the said Samuel Mc Rob ets, unlawfully, wickedly and maliciously'did print and publish, and cause and procure to be composed, printed and published, in the form of a letter to one William S. Fulton, a certain other false, 'scandalous' and defamatory libel, of, and concerning the said Samuel Mc Robertst containing therein, amongst other things, the following false, scandal ous, malicious, defamatory and libellous words and matter, of, and con cerning the said Samuel Mo Roberts, that, is to say: This Mc Rob erts (said Samuel Mc Roberts meaning) must be one of those sufi-i sants or parvenus who having succeeded to snatch from the credulity of an ignorant mass of the people in their savage abode an appomt merit to a high Office, fondly believe themselves to be: truly endowed with such a high respectability of talents and character as to compel all men, of all classes and nations, to admire in silence all their thoughts and doings, even their ridiculous presumption, even their criminal'in solence. In a country where mobocracy is less in honor, this Mc Rob erts would find himself very happy to clean boots at one dollar per month, to the great scandal, infamy and disgrace of the said Samuel Mo Roberts, to the evil example of all others and against the peace of the people of the State of New York and their dignity.

And the Jurors aforesaid upon their oath aforesaid do further present that the said Orazio de Attellis Santangelo, further contriving and in tending as aforesaid, on the said twenty-sixth day of August in the'year of our Lord one thousand eight hundred and forty-two with force and arms etc. At the first ward of the city and county of New York afore said, of his hatred, malice, and ill-will towards the 'said Samuel Mc' Roberts, unlawfully, wickedly and maliciously, dld compose, print and publish, and cause and procure to be composed, printed and published, a certain other false, scandalous, malicious and defamatory. Libel, of, and concerning the said Samuel Mc Roberts, containing therein, amongst other things, the followingfalse, scandalous, malicious, defamatory and libellous words and matter; of, and concerning said Samuel mcroberts, that is to say: the world, to Whom this, circular is addressed, will easily perceive that if not for the enormity Of the crime, certainly fof the re finement of immorality, the Honorable Mitchell, lately condemned to the State Prison of New York, is far. Surpassed by the Honorable MO Roberts (meaning said Samuel Mo Roberts) still a Senator of the United States, to the great scandal, infamy, and disgrace of the said Samuel Mc Roberts, 'to the evil example of all others, and against the peacaof the people of the State of New York and their dignity.
