Sei doch n�tzlich und gut gewesen. Msn solle sie also bei ihrem Schenken und ihren alten Br�uchen, so viel die ziemlich seien, lassen Noch deut licher weisen Aeussernngen Tretsch's darauf hin dass der Landesausschuss von den Reichsordnnngen nichts wissen wollte. Und wir werden kaum fehl schiessen, wenn wir annehmen, es ging, wie wir es in unserem Jahrhundert neu erlebt haben: das vemeinte gute alte Recht wollte die Landschaft auch der vern�nftigen und politisch nothwendigen Neuerung gegen�ber festhalten. Allein eben weil die Neuerung eine Forderung der Nothwendigkeit war, konnte die Sache auf die Dauer so nicht abgewiesen werden. Der Herzog zumal mit seinem staatsm�nnischen Blick liess sich nicht beim. Er bekam dazu mit seinen Rathen einen neuen Fingerzeig daf�r in die Hand, wie nothwendig es sei voran zu machen, als 1560 vor ihn kam, wie die Steinmetzen und Maurer sich herausgenommen haben, eigenm�chtig Versammlungen zu halten, andern Strafen und zwar in ziemlicher H�he aufzulegen und sich eine eigene Ordnung zu geben. So finden wir denn 1561 die Sache nen in Angriff genommen. Vom 14. August 1561 datirt ein ausf�hrlicher Bericht von Tretsch an den Herzog, worin er auf Befehl ganz speciell nachweist, wie es bei den f�rstlichen Geb�uden mit dem Abrechnen gehalten werde, welches die Belohnung und Verdingordnnng bei den Maurern, f�r das gehauene Steinwerk, f�r Zimmer, Schlosser Glaserarbeit, was die Taxen f�r Gipser, Decker, Ziegler, und was der Fuhrlohn sei. Dabei beruft er sich wiederholt auf die beiliegende neue angefangte Bauordnung, worin das N�here verzeichnet stehe; es kann darunter jener erste Entwurf gemeint sein. Auch ist der Bericht bezeichnet als 'die ganze Bauordnung betreflend. Es war eine weitere Vorarbeit in der Sache. Nun liess der Herzog, wie es scheint, gegen Ende September 1561, auch noch eine ganze Reihe fremder einschl�giger Ordnungen zu weiterer Vergleichung kommen. Erhalten sind in den Aden solche von M�nchen (bauordnung von 1489 mit sp�tern Zus�tzen), Ulm (schlosser, Maurer, Decker, Merkelrnerer, Hafner, Binder, Schreiner von 1549; Gesatz und Ordnung, wie man zu Ulm bauen, auch Winkel, Giebel u. Dgl. Machen soll, Augsburg Pforr heim und Durlach (verzeichniss der Taxen bei Bauten in den letzten Jahren, 2. Nov. Hohenlohenenenstein (vor 2. Jan. 1562, Bericht �ber die Taxen und Verdingnngsverh�ltnisse am Neuensteiner Schlossbau; gleichwohl will dann 1565 der Herzog durch den Stuttgarter Obervogt nochmals alles gee nau hier�ber erfahren). Sodann sind noch erw�hnt: Ordnungen von Strass burg, Kolmar und Schlettstadt. Nach Ulm hatte der Herzog den Dr. Gadner selbst gesandt mit einem Schreiben vom 29. Sept. 1561, worin er ganz �ber dieselben Punkte, wie sie Tretsch am 14. August beantwortet hatte, Auskunft erbat. Es war also bereits ein gewisses Schema f�r die Ziele der Bauordnung vorhanden.
