Studienarbeit aus dem Jahr 2014 im Fachbereich Jura - Öffentliches Recht / Staatsrecht / Grundrechte, Note: 10, Fachhochschule für Verwaltung Saarland; Saarbrücken, Sprache: Deutsch, Abstract: Kaum ein anderes Dokument hat in den vergangenen Jahren die öffentliche Bildungsdebatte in der Bundesrepublik so bestimmt, wie die UN-Behindertenrechtskonvention (BRK). Die BRK setzt einen Meilenstein für die Rechte von Menschen mit Behinderung. Sie kehrt sich ab von den bisher praktizierten Maßnahmen der Integration und wendet sich der Inklusion zu. Während Integration davon ausgeht, dass Kinder nach ihrem sonderpädagogischen Förderbedarf Unterstützungsleistungen erhalten, um mit Kindern ohne Behinderung Schritt zu halten, geht das Konstrukt Inklusion von einer anderen Zielrichtung aus. Danach muss eine Bildungseinrichtung alle Anpassungsleistungen treffen, um sich an die Bedürfnisse der Schülerinnen und Schüler anzupassen. Diese Anpassungsleistung kann darin bestehen, besser geschulte Lehrkräfte einzustellen, aber auch die individuelle Leistungsfähigkeit des Kindes zu berücksichtigen und beispielsweise Nachteilsausgleiche bei der Durchführung von Klassenarbeiten zu gewähren. Damit greift der Inklusionsbegriff wesentlicher weiter, erfasst er Schülerinnen und Schüler mit sonderpädagogischen Föderbedarfen, Migrationshintergrund oder auch beispielsweise Kinder mit Hochbegabung. Er lenkt den Blick auf die persönlichen Lernbedürfnisse des einzelnen Kindes und die durch die Gesellschaft geschaffenen Barrieren. Seit Inkrafttreten der Konvention im März 2009 in der Bundesrepublik arbeiten die Länder mit unterschiedlicher Intensität an der Umsetzung der BRK. Noch bevor die Ressourcenfrage allerdings zu stellen ist, geht es darum, herauszufinden, welche konkreten rechtlichen Verpflichtungen aus der BRK erwachsen.
