La question des standards publics et privés dans les relations économiques internationales, et celle de leur statut juridique, soulève de nombreux problèmes, et prend de plus en plus d'importance dans le débat juridique actuel, mais reste pourtant peu connue des juristes: comment peut-on préserver l'équilibre délicat entre choix politique de la norme entre plusieurs options ayant des conséquences différentes pour l'intérêt général, et raisonnement économique qui vise à trouver la norme facilitant les échanges commerciaux de la manière la plus efficace ? Ces normes émergent-elles de manière spontanée, ou doivent-elles être codifiées ? Comment maintient-on le dialogue entre pratique et codification ? Quelle que soit la forme que prennent les standards, existe-t-il une différence entre normes publiques et normes privées ? Les normes édictées par les uns peuvent-elles contrarier ou entrer en conflit avec celles édictées par les autres ? Comment vérifier le respect des normes, alors que, dans un monde globalisé, les opérateurs sont de plus en plus nombreux et dispersés à travers la planète ? Comment assurer la démocratie dans des processus largement privés ?
La présente étude tente d'éclaircir certains de ces points, tout en interrogeant le futur de ces normes. Dans une première partie, nous définirons tout d'abord les termes essentiels au problème, et tenterons de mieux comprendre ce que sont les normes. Dans une seconde partie, nous nous pencherons sur les standards régissant les relations contractuelles, et sur la différence entre harmonisation spontanée et codification active. La troisième partie sera consacrée aux conflits entre standards privés et normes publiques, et à la question de savoir comment les résoudre. Dans une quatrième partie, nous nous intéresserons à la question de la certification comme solution au problème d'effectivité, et verrons quels écueils celle-ci peut amener. Enfin, la dernière partie abordera le problème de la légitimité démocratique, et tentera de repenser le concept de démocratie, appliqué à la problématique qui nous occupe.

Par leur globalité et leur gravité, les menaces pesant sur la biodiversité font naitre un pressant besoin de droit international. Les États ont adopté en 1992, sous l'égide des Nations Unies, la Convention sur la diversité biologique, qui a un champ d'application très large. Mais de nombreuses conventions sectorielles et/ou régionales coexistent à ses côtés et ont vocation à protéger la biodiversité en tant que telle ou certains de ses éléments, tout comme un ensemble de règles coutumières. L'étude du droit international de la biodiversité conduit aussi à dépasser les enjeux, certes essentiels, de protection ou préservation pour aborder les questions que posent l'utilisation et l'exploitation de la biodiversité la pêche, la chasse, le commerce, la biosécurité, ou encore l'accès à la biodiversité et le partage des avantages découlant de l'exploitation des ressources génétiques. En cela, le droit international de la biodiversité entre en interactions, et parfois en conflit, avec d'autres règles du droit international, portant sur le commerce, les investissement...
