L'histoire du droit international privé montre très clairement la nécessité de trouver une solution harmonieuse aux relations juridiques entre personnes privées. En outre, depuis la paix de Westphalie, avec une définition plus claire du concept de l´Etat et de la souveraineté, la source du droit étatique devient centrale et presque exclusive. Mais le monde change, et surtout l´économie cherche la manière d´augmenter le rôle des agents privés. Ainsi, l´autonomie de la volonté dans les contrats internationaux, à côté de l´arbitrage privé, commence à produire un impact remarquable. Le droit international privé ne peut pas être aliéné à cette évolution sans perdre son identité et son propre objet: donner une solution juridique aux relations privées. En conséquence, sans m´éloigner de cette ouverture, j'ai répondu à la question en faveur d'une formule de coordination et de convergence des méthodes normatives.

L'auteur se propose d'examiner quelques questions générales et spéciales de la nouvelle codification du droit international privé chinois réalisée par la loi de la République populaire de Chine du 28 octobre 2010 sur l'application des lois aux relations civiles comportant un élément d'extranéité (entrée en vigueur le 1er avril 2011, qui est considérée comme un pas très important dans l'évolution du droit international privé chinois.
