About the Book

Ralf Selig, Absolvent der SRH Hochschule Heidelberg und Trager des Innovationspreises 2009 der SRH Holding. Nach seiner Ausbildung zum Bankkaufmann studierte er Rechtswissenschaften an der Universitat Mannheim. Im Anschluss an eine mehrjahrige Berufstatigkeit, u. a. im Bereich Marktforschung, begann er ein Studium an der SRH Hochschule Heidelberg im Studiengang Wirtschaftsrecht. Im Rahmen dieses Studiums absolvierte er ein Praxissemester am Zentrum fur Europaische Wirtschaftsforschung (ZEW) in Mannheim. Hier war er im Personalbereich tatig.Im Zeichen eines immer starker werdenden Wettbewerbsdrucks stellt qualifiziertes Personal fur Unternehmen einen wichtigen Faktor dar, um sich erfolgreich am Markt behaupten zu konnen. Fach-, handlungs- und sozialkompetente Mitarbeiterinnen und Mitarbeiter sind essentiell fur die Wettbewerbs- und Innovationsfahigkeit eines Unternehmens. Aufgrund der demographischen Entwicklung werden es Unternehmen jedoch zukunftig immer schwerer haben geeignetes Fachpersonal zu finden. Personalverantwortliche sollten sich der geanderten Gegebenheiten bewusst werden und die Gewinnung zukunftiger Mitarbeiterinnen und Mitarbeiter durch eine diskriminierungsfreie Personalauswahl sicherstellen. Massgebende rechtliche Grundlage fur eine diskriminierungsfreie Personalauswahl ist seit dem 18.08.2006 das Allgemeine Gleichbehandlungsgesetz (AGG), welches jedoch nicht ganzlich unumstritten ist. Die Europaische Kommission geht von der Europarechtswidrigkeit einzelner Regelungen aus und hat Vertragsverletzungsverfahren vor dem Europaischen Gerichtshof eingeleitet. Gegenstand und Ziel des vorliegenden Buches ist es vor dem Hintergrund und der Entstehungsgeschichte des Allgemeinen Gleichbehandlungsgesetzes (AGG) dessen Auswirkungen auf die Personalbeschaffung bzw. -gewinnung aufzuzeigen. Hierzu werden die relevanten arbeitsrechtlichen Regelungen im Hinblick auf Stellenausschreibung, Vorstellungsgesprach, Assessement-Center, Absageschreiben, Vertragsgestaltung und Dokumentation naher erlautert und auch die Thematik der AGG-Hopper nicht unberucksichtigt gelassen. Eingegangen wird auch auf die europarechtlich problematischen Regelungen, weshalb sich das Buch nicht nur an Personalverantwortliche und Praktiker, sondern auch an die Wissenschaft richtet.
