Respect for human rights is the hallmark of a civilised society. All human beings are born free and equal in dignity and rights. They are endowed with reason and conscience and should act towards one another in a spirit of brotherhood."1 The sacred rights of mankind are not to be rummaged for, among old parchments, or musty records. They are written, as with a sun beam in the whole volume of human nature, by the hand of divinity itself; and can never be erased or obscured by mortal power.2 Human rights consideration are relevant to almost every sphere to governmental activity and indeed, to many others areas of public and private life3 as they are considered to be absolutely essential for ensuring the survival and a decent life to all human beings irrespective of their differences. Depending on the terminology adopted, they can also been referred to as natural rights, basic rights or even fundamental rights. There is wide agreement in the world today, especially among democracies, on the political significance of human rights. Every society creates legitimate authority that encompasses the relationships between its members and their relationship to the political authority. A civilised nation cannot ignore the violations of the human rights of its people. It must have effective systems for the prevention of such violations and for punishing the violators.There are different ways of protecting human rights. A pluralist and accountable parliament, an executive who is ultimately subject to authority of elected representatives and an independent judiciary are necessary, but not sufficient, institutional prerequisites.4 Besides these basic 'institutions' there may be other mechanism called 'The National Human Rights Institutions' whose establishment and strengthening will enhance the excising mechanisms. In many cases, the State is seen as a violator of human rights, and in other the State assumes the political responsibility to protect the rights of the vulnerable.This is increasingly being supplemented by a desire to provide for and devise appropriate human rights institutions.
About the Author: The Author has completed her graduation in Arts and Laws. After completing her master of laws (LL.M.) in Constitutional Laws, the author has also done Master of Philosophy (M.Phil) in human rights and hence the author possesses good fundamental knowledge of national and international legal obligations on various issues like the present dealt in the article. The Author is also UGC-NET qualified and has also completed her Doctor of Philosophy (Ph.D.) degree in Law. Being a legal practitioner herself and wife of a judicial officer, the author possess good practical knowledge on various legal aspects as well. Presently, the author is working as Professor of Law for last many years and also discharging administrative liability of I/c. Principal of the college. The Author has fair amount of educational and professional eperience at the various states of India.
