Con este libro del profesor Allan R. Brewer Carías, sobre Principios del Estado de Derecho. Aproximación histórica, se da inicio a la Colección Cuadernos de la Cátedra Mezerhane sobre Democracia, Estado de Derecho y Derechos Humanos, que fue creada en honor del destacado empresario venezolano, Nelson Mezerhane Gossen, mediante acuerdo de cooperación suscrito entre el Miami Dade College y la Fundación José Ortega y Gasset - Gregorio Marañón de España, dentro del marco de su Programa Goberna Las Américas - Miami, que forma parte de la Escuela de Alta Política y Buen Gobierno. La idea fuerza que origino la fundación de la Cátedra es que en una sociedad democrática, los derechos y libertades inherentes a la persona, sus garantías y el Estado de Derecho constituyen una tríada, cada uno de cuyos componentes se define, completa y adquiere sentido en función de los otros, que es necesario divulgar y defender. En ese contexto precisamente se enmarca este libro, que trata el tema de siempre del constitucionalismo moderno que es el de Estado de derecho (état de droit, Rechtstaat; stato di diritto, rule of law) que como sistema de organización política de la sociedad contemporánea, se caracterizado por el hecho de estar regido por una Constitución como pacto político adoptado por el pueblo en ejercicio de su soberanía; en el cual sus representantes electos democráticamente mediante sufragio universal y secreto, gobiernan y ejercer el poder público sometidos a controles conforme al principio de la separación de poderes, y con sujeción plena a la Constitución y a las leyes (principio de legalidad), en un marco en el cual la primacía de la dignidad humana está garantizada, y los derechos del hombre están constitucionalmente declarados y protegidos, y en el cual los ciudadanos pueden exigir el control judicial de todos los actos del Estado. En fin, la idea de la Constitución y su supremacía, la del gobierno representativo fundado en la soberanía popular, la de la separación e independencia de poderes como garantía de la libertad, la de la sujeción del Estado y sus poderes al imperio de la ley y del control jurisdiccional de la constitucionalidad y legalidad de los actos de éstos, y sobre la finalidad de todo ello, como lo es el respeto y garantía de los derechos y las libertades fundamentales, vistos en retrospectiva, son los temas tratados en este Cuaderno, como aporte para cualquier reflexión al respecto o intento de reformulación con vistas al tiempo nuevo y sus distintas manifestaciones en curso.
