El Piloto al Mando es el responsable jurídico de la seguridad y la integridad de la aeronave, de la tripulación y de los bienes que contenga. En Transporte Aéreo Comercial (pasajeros y carga) se denomina Comandante. El Piloto al Mando en trabajos aéreos (hoy Operaciones Comerciales Especializadas - SPO), pocas veces ha reparado en el enorme peso que la Ley le impone y que hace recaer en él todas las responsabilidades jurídicas del vuelo y de los daños que pusiera ocasionar a los terceros en tierra. Hasta la publicación de este Manual no había ninguna otra obra que abordara, de un modo práctico, el estudio y desarrollo conjunto de las normas que rigen sus funciones, atribuciones, obligaciones y responsabilidades.

Hay cientos de disposiciones normativas que van a incidir en estas responsabilidades, cuyo incumplimiento puede ser voluntario, por ignorancia, por errores de interpretación, o por descuidos jurídicos. El Piloto al Mando debe saber cómo evitar las consecuencias de sus posibles errores o desconocimientos sobre las leyes y Reglamentos dispersos que provienen de los Ministerios de Transportes, Movilidad y Agenda Urbana, de Hacienda (Aduanas), de Sanidad, de Interior, entre otros, así como de los Convenios Internacionales, Reglamentos o Decisiones de la Unión Europea y demás normas extranjeras aplicables en los países a donde viaja. Tales normas rara vez llegan al Comandante ni al Piloto al Mando para que pueda aplicarlas. Sólo a través de los Manuales de Operaciones de cada empresa pueden encontrar alguna guía, por lo demás incompleta, en muchas ocasiones obsoleta y mezclada con las normas de régimen interior de las compañías, no pudiendo discernir la categoría de la norma que está aplicando, y las consecuencias jurídicas de su incumplimiento.

Javier Recarte Casanova, con este trabajo, ha tratado de paliar estas carencias, basando sus conocimientos en su currículum como Licenciado en Derecho y Piloto de Transporte de Línea Aérea, lo que le ha proporcionado un visión muy específica de la profesión de piloto pues, en su vida aeronáutica, fue Vocal de Normas de la Asociación Española de Pilotos durante cinco años, promoviendo desde allí el Colegio Oficial de Pilotos de la Aviación Comercial (COPAC); fue Jefe de Seguridad de Vuelo y más tarde Letrado Asesor de la Subdirección de Vuelos de la Compañía Iberia, así como cofundador, Secretario y Asesor Jurídico del Comité Coordinador de Seguridad de Vuelo de las Compañías Aéreas (C.C.S.V.).

Desde su Bufete Aeroley, del que es Director, ha impartido las enseñanzas del Curso sobre Funciones, Atribuciones, Obligaciones y Responsabilidades del Comandante, del que es autor, habiendo instruido en esta materia a cientos Comandantes de varias compañías aéreas, desde 1994.

Es autor y redactor de la revista aeronáutica "AEROLEY".
