Seit den siebziger Jahren wird die Leiharbeit in den Betrieben angewendet und durch das Gesetz zur Regelung der gewerbsmäßigen Arbeitnehmerüberlassung (AÜG) von 1972 gesteuert. Eine stetige Verbreitung dieser Beschäftigungsform bewirkte jedoch die Veränderung des AÜG: Ab dem 01.01.2003 galt, dass ab dem dreizehnten Überlassungsmonat eines Arbeitnehmers an einen Entleiher dem Leiharbeitnehmer die Lohn- und Arbeitsbedingungen vergleichbarer Arbeitnehmer im Entleihbetrieb ('Stammarbeitnehmer') gewährt werden müssten. Später sollte dieses Gleichbehandlungsgebot sogar schon ab dem ersten Monat der Arbeitnehmerüberlassung gelten. Die daraufhin abgeschlossenen Tarifverträge haben in der Gesellschaft sowie in der Wissenschaft eine Diskussion über die Handhabung des "Equal Pay"-Prinzips ausgelöst, oft mit der Argumentation, dass durch die niedrigen Tarifverträge ein Instrument zur Umgehung dieses Gleichbehandlungsgebots geschaffen wurde. Auf der gesamtwirtschaftlichen Ebene bewirkten die Tarifverträge einerseits einen "Lohndumping" auch in anderen Branchen, wie in der Gebäudereinigung, andererseits kam es zu einem "Strukturwandel" und sogar zu einer "Erosion" auf dem Arbeitsmarkt. In diesem Zusammenhang wurde von einer "Abkehr vom "Normalarbeitsverhältnis" mit einer langfristigen Bindung der Arbeitnehmer an ein Unternehmen" in die Richtung der neuen Beschäftigungsformen gesprochen. In der Betriebswirtschaft wird diese Tendenz durch die Flexibilisierungsstrategien im Personalmanagement erklärt. Theoretische Begründungen werden aber auch mit Hilfe des Transaktionskostenansatzes ausgearbeitet, und zwar nach dem Muster von "Make-or-Buy"-Entscheidungen.
