Die bisherige Rechtspraxis soll durchleuchtet und kritisch hinterfragt werden. Dabei soll auch die Forderung nach Einführung einer Erheblichkeitsschwelle für Bagatelldelikte erörtert werden. "Wer klaut, der fliegt", so wurde zu Teilen die strenge Linie der Rechtsprechung seit dem grundlegenden "Bienenstich"-Urteil aus dem Jahre 1984 bei Kündigungen wegen geringwertiger Vermögensdelikte gegen das Arbeitgebereigentum interpretiert. In den letzten Jahren häuften sich in den Medien Berichte über Fälle, in denen Arbeitnehmern wegen geringfügiger Vermögensdelikte gekündigt wurde. Diese Sachverhalte und insbesondere der sog. "Emmely"-Fall, in dem einer Kassiererin wegen des pflichtwidrigen Einlösen zweier Pfandbons im Wert von 1,30 EUR gekündigt worden war, lösten in der Gesellschaft eine Gerechtigkeitsdebatte über die Wirksamkeit von Kündigungen wegen sog. Bagatelldelikten aus. Die gesellschaftspolitische Diskussion gab zudem den Anstoß zu drei inzwischen gescheiterten parlamentarischen Initiativen der damaligen Opposition. Diese sahen alle im Wesentlichen vor, dass einer außerordentlichen Kündigung wegen eines geringfügigen Vermögensdelikts eine Abmahnung vorausgehen müsse. Im Zusammenhang mit der Überlegung, bis zu welchem Wert ein Vermögensdelikt geringfügig ist, wurde in der Literatur auch die Einführung einer Bagatellgrenze diskutiert. Ihre vereinzelte Forderung wurde mit Wertungswidersprüchen gegenüber der Rechtspraxis der ordentlichen Gerichtsbarkeit und der Verwaltungsgerichte begründet.
