Elles s'intéressent a l'analyse de la réaction de la société ou son degré de tolérance face a certains comportement individuels, ainsi qu'a son attitude face a la législation en vigueur et au système d'intervention. Elle tente de démontrerDes actes réputés nocifs par la citée et qui ne sont pas pour autant incrimines et propose de les considérer comme infraction que certains actes incrimines sont si bien tolérés par la société qu'il vaut mieux les dépénaliser. La désuétude d'une loi ou son inefficacité et ainsi proposer son abrogation.Les failles d'une loi ou son inefficacité et ainsi, proposer son abrogation.Les failles qui existent au niveau de telle ou telle institution du système pénal: la police, la justice, les instances correctionnelles.La nécessité de faire usage de mesures novatrices pour mieux réagir face à certaines infractions ou certains individus.La recherche, en sociologie du droit s'inscrit dans une perspective critique on peut choisir soit une option réformatrice; dans ce cas, on propose des améliorations au fonctionnement de la société. On peut être également radicale; de ce fait on rejette l'état de chose existant et propose de changer totalement. Prenons par exemple une recherche qui porterait sur le traitement des enfants inadaptés dans les institutions fermées (un centre d'accueil). Dans le cas ou celle-ci aboutit a un manque de résultats sur l'efficacité des méthodes utilisées, de deux attitudes sont possibles. Soit le chercheur propose des mesures de redressement, dans ce cas, il est réformateur; soit il propose de remplacer cette institution par une autre tout à fait différente voire même de changer d'approche, dans ce cas il est révolutionnaire.
