Inhaltsangabe: Problemstellung: „Musikverkauf übers Handy soll Riesengeschäft werden" lautet eine Schlagzeile aus dem Handelsblatt. Ferner heißt es dort: „Die Mobilfunkanbieter wollen das Handy als neue Vertriebsform für Musik etablieren und damit den Internetshops wie I-Tunes die Kunden wegschnappen. Ganz nebenbei soll der Musik-Download auch UMTS zum Erfolg verhelfen." Vor einiger Zeit lief bereits die digitale und legale Distribution von Musik im Internet an. Als eines der dabei weltweit erfolgreichsten Unternehmen hat sich die Firma Apple mit dem iTunes Music Store im Markt etabliert, der im April 2003 in den USA und ein Jahr später in Europa startete. Nachdem der illegale Download von Musik-Dateien über das Internet in den letzten 6 Jahren der Musik-Industrie ungefähr 40 Prozent an Umsatzeinbußen bescherte, ist das Anbieten legaler Alternativen zum Herunterladen von Musik ein erster Schritt, diesem Trend entgegen zu wirken. Dennoch steckt dieser Vertriebsweg noch in den Kinderschuhen. Der Anteil von legalen Musik-Downloads am Gesamtgeschäft im deutschen Musikmarkt beträgt Mitte 2004 gerade mal 1 bis 2 Prozent. Das Wachstum sei aber rasant, so Phonoverbandschef Gerd Gebhardt anlässlich der popkomm Messe in Berlin. Noch weiter in die Zukunft gedacht liegt der Gedanke nah, in der heutigen von ständiger Informations-Verfügbarkeit und größtmöglicher Mobilität geprägten Gesellschaft, über mobile Geräte Musik-Angebote zu durchsuchen, Musik zu bezahlen, herunterzuladen und zu konsumieren. Dieser mobile Weg ist in vielerlei Hinsicht die logische Konsequenz aus den bisherigen Entwicklungen. Zum einen ist der Mobilfunkkunde daran gewöhnt, für Dienste Geld zu bezahlen, während im Internet seit jeher eine Art „Kostenlos-Mentalität" der Nutzer herrscht, die schwer umkehrbar ist.
