Veränderungen in diesem Umfeld wirken sich oftmals auf die Lebensführung des Angestellten aus. Da sich der Mitarbeiter über diesen Umstand im Klaren ist, sucht er nach Möglichkeiten, sich an diesen Entscheidungen zu beteiligen. Der Unternehmer andererseits wird durch eine derartige Mitbestimmung teilweise von der freien Unternehmensleitung abgehalten, wodurch er nicht mehr ausschließlich auf die Marktbedürfnisse reagieren kann, sondern auch die Mitbestimmungsrechte seiner Angestellten berücksichtigen muss. Aufgrund dieser Überlegungen stellt sich die Frage, ob Mitbestimmung im Unternehmen zu Effizienzverlusten führt, oder ob vielleicht doch die positiven Effekte, wie sie durch verbesserte Kommunikation, den Abbau von Informationsasymmetrien oder verringertes Konfliktpotential entstehen, gegenüber der "Verlangsamung und Verteuerung betrieblicher Prozesse" (Hinderlich 2007) überwiegen. Die empirischen Befunde sind hier, trotz einer Vielzahl entsprechender Studien, grundsätzlich widersprüchlich. Des Weiteren beziehen sich die Studien im Einzelnen auf unterschiedliche positive Effekte und Beteiligungssysteme. Eine eindeutige Aussage zur Wirkung von Mitarbeiterbeteiligung lässt sich, innerhalb des wissenschaftlichen Diskurses, bis heute nicht treffen. Ziel dieser Arbeit soll es daher sein, die Mitbestimmung in Unternehmen aus der Perspektive der Neuen Institutionenökonomik, hier insbesondere aus dem Blickwinkel der Verfügungsrechtetheorie zu betrachten, um so einen theoretischen Ansatz zur Beantwortung der Frage zu finden, ob Mitarbeiterbeteiligung eher einen unternehme
