English summary: Once again, Jan Schapp provides access to a number of his essays on legal methodology written between 1992 and 2007, which establish a new basis for legal methodology. He no longer focuses on the general criteria for the interpretation of a law, but rather on the relationship between the case, the law and the judicial decision. He sees the law and the judge's verdict as a ruling on conflicts in an assumed reality of life. This ruling is done on the basis of the theory of claims which develops into a system of civil law. Public law, with new problems, is added to this. Thus the author provides a methodology which can be understood as a concept for teaching and studying law. No longer in a peripheral position, methodology becomes the focal point of the law and jurisprudence. German description: Im vorliegenden Band macht Jan Schapp eine Reihe seiner Aufsatze zur juristischen Methodenlehre aus den Jahren 1992-2007 erneut zuganglich. Er stellt dabei anknupfend an eigene fruhere Arbeiten die juristische Methodenlehre auf eine neue Grundlage. Im Mittelpunkt steht fur ihn nicht mehr die Frage nach den allgemeinen Kriterien der Auslegung von Gesetzestexten, sondern das Verhaltnis von Fall, Gesetz und richterlicher Entscheidung. Gesetz und Richterspruch begreift er als Entscheidung von Konflikten einer vorausgesetzten Lebenswirklichkeit. Diese Konfliktsentscheidung erfolgt aufgrund der Lehre vom Anspruch, die als System des Zivilrechts entfaltet wird. Immer klarer tritt dabei die Bedeutung der romisch-rechtlichen Unterscheidung von res und actio als zentrales Motiv auch fur ein modernes Rechtsdenken hervor. Sie ermoglicht es, die grundlegenden Institutionen des Rechts auf ein System der Anspruche zu beziehen und beide zu einem System des Zivilrechts zusammenzufugen. Ihm schliesst sich dann das offentliche Recht mit neuen Fragestellungen an.Der Autor skizziert die praktische Arbeit des Richters wirklichkeitsnah, bettet sie dabei aber zugleich auch in grossere geisteswissenschaftliche Zusammenhange ein. Fur das deutsche ohnehin stark am Anspruch orientierte Rechtsdenken bietet sich so eine Methodenlehre verstanden als Konzeption fur Lehre und Studium des Rechtes an. Zugleich werden Zuge einer zukunftigen europaischen Rechtswissenschaft erkennbar. Die Methodenlehre ruckt aus einer Randlage in das Zentrum von Recht und Rechtswissenschaft.
