S'il avait su, s'il avait pu savoir ce qu'il était, il n'eût reconnu à de tels juges aucune autorité, aucun droit. S'il fut faible, ce fut précisément en ne fuyant pas, en gardant cette illusion qu'il avait encore quelque chose de commun avec les Athéniens, et en s'imaginant n'être qu'un membre, un simple membre de ce peuple. Il était bien plutôt ce peuple même en personne, et seul il pouvait être son juge. Il n'y avait point de juge au-dessus de lui: n'avait-il pas d'ailleurs prononcé la sentence ? Il s'était, lui, jugé digne du Prytanée. Il aurait dû s'en tenir là, et n'ayant prononcé contre lui aucune sentence de mort, il aurait dû mépriser celle des Athéniens et s'enfuir. Mais il se subordonna, et accepta le Peuple pour juge: il se sentait petit devant la majesté du Peuple. S'incliner comme devant un " droit " devant la force qu'il n'aurait dû reconnaître qu'en y succombant, c'était se trahir soi-même, et c'était de la vertu. La légende attribue les mêmes scrupules au Christ, qui dit-on, ne voulut pas se servir de sa puissance sur les légions célestes. Luther fut plus sage; il eut raison de se faire délivrer un sauf-conduit en bonne forme avant de se hasarder à la diète de Worms, et Socrate aurait dû savoir que les Athéniens n'étaient que ses ennemis et que lui seul était son juge. L'illusion d'une justice, d'une légalité, etc., devait se dissiper devant cette considération que toute relation est un rapport de force, une lutte de puissance à puissance.
