Le terme lex talionis ne fait pas toujours et uniquement référence à des codes de justice littéralement oeil pour oeil (voir plutôt la punition miroir) mais s'applique à la classe plus large des systèmes juridiques qui spécifient la formulation de sanctions pour des crimes spécifiques, qui sont considérés être adapté à leur gravité. Certains prétendent que cela visait au moins en partie à empêcher des sanctions excessives de la part d'un parti privé vengeur ou de l'État. L'expression la plus courante de la lex talionis est oeil pour oeil, mais d'autres interprétations ont également été données. Les codes juridiques suivant le principe de la lex talionis ont une chose en commun: une contre-punition appropriée prescrite pour un crime. Dans le célèbre code juridique écrit par Hammurabi, le principe de réciprocité exacte est très clairement utilisé. Par exemple, si une personne causait la mort d'une autre personne, le tueur serait mis à mort. L'exemple le plus simple est le principe "oeil pour oeil". Dans ce cas, la règle était que la peine devait être exactement égale au crime. Inversement, les Douze Tables de Rome ont simplement prescrit des sanctions particulières pour des crimes particuliers. Le code juridique anglo-saxon a substitué le paiement du wergild à la rétribution directe: la vie d'une personne particulière avait une valeur fixe, dérivée de sa position sociale; tout homicide a été indemnisé en payant le wergild approprié, indépendamment de l'intention. En vertu de la Common Law britannique, les demandeurs retenus avaient droit à un remboursement égal à leur perte (en termes monétaires). Dans le système moderne du droit de la responsabilité délictuelle, cela a été étendu pour traduire également les pertes non économiques en argent. Le sens du principe Eye for an Eye est qu'une personne qui a été blessée par une autre personne retourne l'action incriminée à son auteur en compensation, ou qu'une autorité le fait au nom de la personne blessée. La traduction exacte du latin (lex talionis) en anglais de cette phrase est The law of repraliation. Le principe fondamental de cette loi est de fournir une rétribution équitable.
