Diplomarbeit aus dem Jahr 2007 im Fachbereich Jura - Öffentliches Recht / Verwaltungsrecht, Note: 1,5, Hochschule Harz - Hochschule für angewandte Wissenschaften (FH), Sprache: Deutsch, Abstract: Das bisherige Tarifwerk, der Bundesangestelltentarifvertrag (BAT), war über 45 Jahre nicht nur in den öffentlichen Verwaltungen, sondern in sinngemäßer Anwendung auch in vielen privatwirtschaftlichen, gemeinnützigen und kirchlichen Bereichen maßgeblich. Seit dem 1. Oktober 2005 gehört er in der Kommunal- und Bundesverwaltung nunmehr der Vergangenheit an. Mit dem TVöD ist die größte Reform des Tarifrechts im öffentlichen Dienst seit der Einführung des BAT im Jahre 1961 verbunden, denn mit ihm ist die Vergabe einer variablen, leistungsorientierten Bezahlung ermöglicht worden. Den öffentlichen Arbeitgebern wird damit erstmals die tarifliche Gelegenheit der leistungsabhängigen Entlohnung der Beschäftigten eingeräumt. Die Führungskräfte im öffentlichen Dienst konnten bisher, bedingt durch das Alimentationsprinzip des BAT, kaum Erfahrungen mit materiellen Entlohnungssystemen sammeln. Es bestand keine Möglichkeit, entsprechendes Engagement und Leistung der Mitarbeiter in Form von finanziellen Anreizen zu fördern. Ebenso besaß die Personalbeurteilung eher eine geringfügige Bedeutung. Aus diesen Gründen muss bei der Umsetzung der leistungsorientierten Bezahlung in der Praxis durchaus mit Kompetenzdefiziten von Seiten der Vorgesetzten gerechnet werden, was umfassende Schulungen sowie die regelmäßige Auffrischung spezifischer Aspekte des Leistungsbeurteilungsprozesses unabdingbar macht. Denn mit dem neuen Tarifrecht ergibt sich für die Führungskräfte erstmals sogar die rechtliche Verpflichtung, ein, sich am Grundsatz der Gleichbehandlung orientierendes, Leistungsanreizsystem zu entwickeln, was eine Personalbeurteilung unumgänglich macht.
