Coincido completamente con las ideas de Luther King, principalmente donde hace alusión a que "una ley injusta no es ley", y que por tanto, no deberían ser obedecidas; y también cuando cita a Tomás de Aquino refiriendo que "una ley injusta es una ley elaborada por los hombres que no hunde sus raíces en las leyes eternas y en el Derecho Natural"; y esto se traduce en que dicha ley no tiene sus fundamentos ni en la ley natural ni en la ley moral, y por ende, no es verdadera ley. En efecto, el autor señala también que "Cualquier ley que degrade a las personas es injusta", lo que significa que análogamente, la legalización del aborto es una ley injusta evidentemente, puesto que no solo degrada, sino que destruye arbitrariamente la vida de las personas humanas. En este sentido, es oportuno hacer énfasis en el recordatorio que alude sobre el terrible Holocausto histórico al respecto de las leyes injustas en apariencia justas: No debemos olvidar nunca que todo lo que hizo Adolf Hitler en Alemania fue "legal" y que todo lo que hicieron los luchadores de la libertad en Hungría fue "ilegal". Ahora bien, haciendo una analogía, podría decirse que de la misma forma en que Alemania permitió legalmente un genocidio mediante una ley injusta, México lo hace mediante la legalización del aborto. En conclusión, valerse de una ley para matar a personas inocentes en cualquier estado, situación o condición, será siempre un acto inmoral e injusto, o sea, una degeneración manifiesta de la ley. Para hablar propiamente de constitucionalidad, conviene preguntarse a la luz de la razón y echando una mirada al pasado de nuestro país, ¿El aborto es un delito? ¿Era penalizado cuando se creó la Constitución Mexicana? Haciendo un análisis de los hechos que sucedieron en un inicio al respecto, históricamente nuestra Constitución prohibía el aborto debido a su naturaleza delictiva, es decir, que era considerado como una conducta típica, antijurídica, culpable y punible. En efecto, matar a un inocente es una conducta contraria a la ley que debe ser castigada por el Estado; entonces, surgen algunas interrogante que derivan de estas afirmaciones, ¿Si es evidente que el aborto es un delito, por qué en pleno siglo XXI arbitrariamente se despenaliza en la Capital de nuestro país? O bien, ¿Cómo es posible que lo que siempre ha sido un delito grave se convierta en algún momento de la historia en algo permitido por el Estado? ¿Con qué derecho los legisladores en turno han aprobado una ley injusta que contraviene el derecho fundamental a la vida y acaba con miles de seres humanos inocentes cada día? ¿Acaso no es una contradicción permitir el aborto en la Ciudad de México y al mismo tiempo prohibirlo en casi todos los demás Estados de la República? ¿Son lícitas y justas las causas por las cuales se ha legalizado el aborto en nuestra sociedad? En la medida de lo posible, en este libro trataremos de llegar a la verdad respondiendo a cada una de estas interrogantes.
