Creemos que el Derecho del Trabajo contemporáneo se debe enfocar principalmente en la persona prestadora de servicios laborales subordinados y su ambiente de trabajo, y muy particularmente en el estudio y desarrollo de los derechos del trabajador como persona y ciudadano frente a su patrono, en relación con su entorno en su centro de trabajo, a lo que se suele referir como ciudadanía en la empresa. En efecto, el Derecho del Trabajo es una disciplina que está inusitadamente referida a la protección de uno de los sujetos de la relación laboral, el trabajador, y la mayoría de sus normas están elaboradas para protegerlo, e incluso su normativa está menos interesada en las obligaciones propias de esa relación de trabajo, en su objeto y en su causa, que en la persona física del trabajador.Por ello es nuclearmente importante revisar los remedios otorgados por las normas jurídicas, y aplicados por los órganos jurisdiccionales, para la adecuada protección de los derechos del trabajador en su condición de ser humano. La dignidad de la persona del trabajador, los derechos inviolables que le son inherentes, el libre desarrollo de la personalidad, el respeto a la ley y a los derechos de los demás, constituyen el fundamento del orden político y de la paz social, y deben ser recogidos por el ordenamiento laboral. En los últimos años ha aumentado la preocupación entre los investigadores de la salud y la seguridad en el trabajo, ante el crecimiento de tipos de conductas laborales con efectos adversos para la salud, seguridad y bienestar de los trabajadores. La globalización, el aumento de competencia y la movilidad trasnacional, el subempleo y la inestabilidad laboral sin duda influyen psicológicamente en nuestra vida profesional. Surge así el estudio sobre la figura del hostigamiento en el trabajo que ha sido tímidamente desarrollada por la doctrina patria, no obstante que se reseña un aumento progresivo del hostigamiento psicológico laboral. Se trata de una figura más común de lo que parece, que propicia un profundo deterioro psíquico en el trabajador, y de allí que parte importante de su estudio derive de la psicología, que ha de entrelazarse con el Derecho para lograr una visión general. Y aunque marcado por una ciencia extraña para el jurista, la figura ha logrado un desarrollo interesante y progresivo en el ámbito del Derecho del Trabajo.
