English summary: In contemporary legal history, Hermann Weinkauff is associated primarily with his term as President of the German Federal Supreme Court in Karlsruhe (1950-1960) and his participation in the so-called post-war renaissance of natural law in theory and in practice. However, most people are unaware of his many other occupations, for example in Bavaria as a public prosecutor in the Bavarian Ministry of Justice or later as president of the district court and as a member of the Bavarian constitutional court. Daniel Herbe looks into these and his various other activities. For the first time, he evaluates new sources which were made accessible to him from Weinkauff's estate, which is privately owned, and numerous archives. The result is an entirely new and more complete and differentiated image of Hermann Weinkauff as a person and of his works. German description: Daniel Herbe widerlegt die bisherige Annahme der rechtsgeschichtlichen Forschung, Hermann Weinkauff habe eine naturrechtliche Lehre vertreten und als Prasident des BGH eine Naturrechts-Rechtsprechung mitgetragen, und macht deutlich, dass dies nur auf Weinkauffs theoretisch entworfene Lehre zutrifft. Der Autor zeigt, dass der Protestant Weinkauff eine idealistische, theologisch schwache Naturrechtsansicht vertrat. Diese erwies sich als ein Konglomerat aus Teilen der katholischen Moraltheologie, aus Teilen der evangelischen, von dem Schweizer Theologen Emil Brunner vertretenen Auffassung sowie der evangelischen von Erik Wolf und anderen vertretenen Meinung und der profanen Rechtsphilosophie im Sinne der Scheler-Hartmann'schen Wertethik. Die Analyse der von Hermann Weinkauff mitgetragenen Rechtsprechung ergibt, dass tatsachlich nur in sehr wenigen Entscheidungen naturrechtliche Ausfuhrungen zu tragenden Grunden wurden. In diesen Fallen legte das Gericht methodisch mit Hilfe von Ruckgriffen auf das Naturrecht wertausfullungsbedurftige Gesetzesbegriffe aus, um einerseits die Strafbarkeit der Kuppelei zu begrunden und um andererseits uber das geltende positive Recht hinaus zu gehen, in dem es z.B. die Strafbarkeit des Selbstmordes und des Ehebruches schuf. Im Ergebnis zeigt sich, dass der BGH diesen Ruckgriff auf das Naturrecht als Auslegungshilfe nicht im Allgemeinen, sondern nur in diesen Ausnahmeentscheidungen vornahm. Hermann Weinkauff vertrat zudem die Idee der Grossen Justizreform und wollte eine neue, starke, rechtsstaatliche Justiz schaffen, deren Gerichte mit einem neuen Typ Richter nach angloamerikanischem Vorbild besetzt sein sollte.
