Doch auf dem Arbeitsplatz muss einem bewusst sein, dass selbst irrtümlich erzeugter Schaden nicht ohne Folgen bleiben kann. Doch welches Ausmaß der Strafe ist an dieser Stelle angemessen? Dabei spielen die Umstände bei der Entstehung des Schadens eine entscheidende Rolle. Auch das Wollen oder Nichtwollen ist in solchen Situationen entscheidend. Ein kleines Beispiel zur Veranschaulichung dieser verzwickten Lage: Die Sekretärin stellt die halbvolle Kaffeetasse unmittelbar neben dem Drucker ab, kippt diese aus Unachtsamkeit um und der Kaffee läuft in den Drucker und beschädigt ihn. An dieser Stelle stellt sich die Frage: Wer haftet für den Schaden? In der folgenden Hausarbeit geht es um die Haftung des Arbeitnehmers für Schäden an Arbeitsmitteln. Dabei werden die verschiedenen Haftungssgrade der Fahrlässigkeit unterschieden. Zusammenfassend lässt sich sagen, dass der Arbeitnehmer für das Eigentum seines Arbeitgebers eine Obhut- und Bewahrungspflicht hat. Von großer Bedeutung ist an dieser Stelle die Entscheidung über die Wahl der Schwere der fahrlässigen Handlung. Denn diese leitet dann ein entsprechendes Verfahren ein. Für den jeweiligen Arbeitnehmer gilt, dass er stets nach bestem Wissen und Gewissen zu handeln hat. Bei einem vorsätzlich verursachten Schaden muss in jedem Fall mit einer entsprechenden Strafe gerechnet werden. Ein Verhalten bei dem der Handelnde den Erfolg seines Verhaltens voraussieht und bewusst herbeiführt, wird in Zivilrecht als rechtwidriges Verhalten bezeichnet. Aufgrund dessen haftet für Vorsatz immer der Schuldner. Für den Arbeitgeber gibt es ausnahmslos keine anteilige Haftung.
