English summary: For the first time, Armin Englander studies the entire range of the legal institution of the defence of another person from the perspective of criminal law. In doing so, he explores the ratio legis of this defence, the relationship between self-defence and the defence of others, the relationship and the differences to government measures taken to avert an imminent danger, the problems of imposed defence of another person and the so-called social-ethical restrictions to this defence. Based on the right of the victim, the author develops a concept of defending another person as it relates to the rights of the individual, a concept which establishes the power to defend another person in accordance with section 32 of the German Penal Code and which determines its scope, explains the existing system of graduated emergency rights and the differences to the state's right to take measures to avert danger in a new way. In doing so, the author closes a research gap in the general section of criminal law. German description: Die Nothilfe fristet - entgegen ihrer praktischen Bedeutung - in der strafrechtswissenschaftlichen Diskussion weitgehend ein Schattendasein. Zumeist werden die aus der Beschaftigung mit dem Zwei-Personen-Verhaltnis zwischen dem Angreifer und dem sich selbst verteidigenden Angegriffenen gewonnenen Einsichten uber Grund, Voraussetzungen und Grenzen der Notwehr einfach auf die Nothilfe ubertragen und dann lediglich um einige bereichsspezifische Uberlegungen erganzt. Eine solche Fokussierung auf die Notwehr im engen Sinn birgt indes die Gefahr von Verkurzungen und Verzerrungen. Armin Englander nimmt dagegen von vornherein das Drei-Personen-Verhaltnis zwischen Angreifer, Angegriffenem und Nothelfer ins Blickfeld und erortert aus strafrechtlicher Perspektive das Rechtsinstitut der Nothilfe erstmals in seiner gesamten Bandbreite. Er untersucht dabei unter anderem die ratio legis der Nothilfe, die Konkurrenz zwischen Selbst- und Fremdverteidigung, das Verhaltnis zur staatlichen Gefahrenabwehr, die Problematik der aufgedrangten Nothilfe und die sogenannten sozialethischen Einschrankungen der Nothilfe. Ausgehend von den subjektiven Rechten des Angegriffenen entwickelt der Autor eine individualrechtliche Nothilfekonzeption, die die von 32 StGB eingeraumte Befugnis zur Verteidigung eines anderen begrundet, ihre Grenzen bestimmt, das System abgestufter Notrechte plausibel macht und die Unterschiede zum staatlichen Gefahrenabwehrrecht erklart. Damit schliesst er eine Forschungslucke im Allgemeinen Teil des Strafrechts.
