Inhaltsangabe: Einleitung: Der Dienstvertrag stellt einen typisch gegenseitigen Vertrag dar, bei dem die beiden Vertragspartner wechselseitig durch Rechte und Pflichten verbunden sind. Zum wesentlichsten Inhalt dieses Vertrages gehört auf der Seite des Dienstnehmers die Pflicht, die vereinbarten bzw. angemessenen Dienste zu leisten (§ 1153 ABGB), und auf der Seite des Dienstgebers die Pflicht, das vereinbarte bzw. angemessene Entgelt zu bezahlen (§ 1152 ABGB). Diesen Pflichten entsprechen wechselseitige Rechte. Der Inhalt des Dienstvertrages ist jedoch damit bei weitem nicht ausgeschöpft. Es gibt daneben noch eine Reihe von gegenseitigen Rechten und Pflichten, die zum Teil ausdrücklich durch Gesetz, Kollektivvertrag oder Einzelvereinbarung festgelegt, zum Teil aber auch durch Judikatur und Lehre herausgearbeitet und anerkannt wurden.' Die Problematik, die dieser Arbeit zu Grunde liegt, und die den Gegenstand derselben bilden soll, ist die im österreichischen Arbeitsrecht noch nicht hinreichend geklärte Frage, inwieweit ein Dienstgeber den Dienstnehmer einseitig vom Dienst freistellen kann, bzw ob ihn die Pflicht trifft, den Dienstnehmer tatsächlich zu beschäftigen (Beschäftigungspflicht des Dienstgebers). Aus der Sicht des Dienstnehmers stellt sich zugleich die Frage, ob er während des Bestandes des Dienstverhältnisses ein Recht d.h. einen klagbaren Anspruch darauf hat, vom Dienstgeber die Annahme seiner Arbeitsleistung, also die tatsächliche Verwendung seiner Arbeitskraft zu verlangen (Beschäftigungsanspruch des Dienstnehmers). Es geht also darum aufzuzeigen, wo sich die Grenzen zwischen diesen beiden widerstreitenden Rechtspositionen befinden. Außerdem soll diese Arbeit auch diesbezügliche Entwicklungen und Tendenzen der Wandlung sowohl der herrschenden Lehre als auch der Rechtsprechung aufzeigen. Anhand rechtsvergleichender Überlegungen mit Deutschland - wo die Entwicklung auf diesem Gebiet schon weiter fortgeschritten ist - soll schließlich überdacht werden,
