English summary: Michael Heese has developed the first system of creditors' information in insolvency on the basis of German constitutional law and a comparative analysis of American insolvency law in the form of the Bankruptcy Code. From a creditor's perspective, information in a case of bankruptcy is the basis for enforcing claims, for participation in the proceedings, and for the transparency of the proceedings. Michael Heese provides a comprehensive analysis of the shortcomings of the current restrictive prevailing opinion in Germany regarding information as expressed in legislation, judicial opinions, and scholarly commentary. His analysis is based primarily on the goals of the information system, the constitutional guarantees which must be considered when implementing these goals, and a comparison with American law. The author's observations regarding the weaknesses in current German law result in his suggestions for legislative reforms to the extent that the weaknesses cannot be addressed in a manner that conforms to the existing system. German description: Informationen sind fur den Glaubiger im Insolvenzfall die Grundlage effektiver Forderungsdurchsetzung, Verfahrensbeteiligung und Verfahrenstransparenz. Michael Heese entwickelt erstmals ein System der Glaubigerinformation in der Insolvenz auf der Grundlage des deutschen Verfassungsrechts und einer rechtsvergleichenden Analyse des U.S.-amerikanischen Insolvenzrechts in Gestalt des Bankruptcy Code. Er wendet sich gegen die in Deutschland vorherrschende restriktive informatorische Grundhaltung und liefert die erste geschlossene Darstellung der informationsrechtlich relevanten Verfassungsparameter. Dabei werden die Justizgewahrleistung, der Anspruch auf rechtliches Gehor und effektiven Rechtsschutz sowie die Gleichbehandlung im Verfahrensrecht in ihrer durch die Institutsgarantie des Insolvenzverfahrens erlangten besonderen Auspragung ebenso eingehend behandelt wie die den Informationsfluss begrenzenden Vorgaben des schuldnerischen Kreditschutzes, des Unternehmensgeheimnisschutzes und des allgemeinen Personlichkeitsrechts. Der Autor entwickelt die Informationsordnung des deutschen Insolvenzrechts fur ihre Hauptverfahrensabschnitte: das Eroffnungsverfahren, das eroffnete Verfahren und die Abweisung des Eroffnungsantrags mangels Masse. Jedem Abschnitt stellt er eine umfassende rechtsvergleichende Analyse des U.S.-amerikanischen Insolvenzrechts voraus. Die durch Verfassungsinterpretation und Rechtsvergleich hervortretenden Schwachen des geltenden deutschen Rechts werden soweit moglich systemkonform korrigiert und im Ubrigen zur Reform durch den Gesetzgeber empfohlen.Das Buch wurde mit dem Wissenschaftspreis 2008 des Gravenbrucher Kreises und mit dem Fakultatspreis 2009 der Juristischen Fakultat der Georg-August-Universitat Gottingen ausgezeichnet.
