English summary: Present German liability law is not based on a coherent system of disgorgement of profits. If disgorgement of profits is allowed, there will be a danger that the injured party receives more than he would have if the matter had been allowed to take its course without disruption. If however disgorgement of profits is rejected, the lawbreaker will keep the profits which he would not have made without the breach of the law. Tobias Helms examines all the countervailing measures in German liability law and shows that the disgorgement of profits does not really aim at preventing violations of the law in general; it actually constitutes a sanction for a specific injustice. The author describes the criteria on which the granting of disgorgement awards under current German law should really depend. German description: Dem geltenden deutschen Haftungsrecht liegt kein koharentes System der Gewinnabschopfung zu Grunde. Verantwortlich hierfur sind nicht nur die Luckenhaftigkeit, Unbestimmtheit und Widerspruchlichkeit der einschlagigen gesetzlichen Bestimmungen. Die zivilrechtliche Gewinnabschopfung wirft auch ein grundlegendes Wertungsproblem auf: Wird eine Gewinnabschopfung zugelassen, so besteht die Gefahr, dass der Verletzte mehr erhalt, als er bei ungestortem Verlauf der Dinge jemals erlangt hatte. Wird eine Gewinnabschopfung aber verweigert, so wird in Kauf genommen, dass dem Verletzer ein Vorteil verbleibt, den er ohne den Rechtsbruch niemals erzielt hatte. Tobias Helms untersucht die haftungsrechtlichen Ausgleichsmechanismen des deutschen Rechts auf ihren Beitrag zur Losung der Gewinnabschopfungsfrage, angefangen vom Bereicherungsrecht uber die Haftung wegen Geschaftsanmassung und die deliktische Schadensersatzhaftung bei Verletzung von Immaterialguter- und Personlichkeitsrechten bis zum Anspruch auf das stellvertretende commodum sowie die Haftung wegen Verletzung von Treuepflichten. Der Autor zeigt, dass die Gewinnhaftung nicht so sehr dazu dient, Rechtsverletzungen allgemein vorzubeugen, sondern eine Sanktion fur ein spezifisches Unrecht darstellt. Dabei liegt der einheitliche Grundgedanke stets darin, dass der von der Rechtsordnung gewahrte Schutz unvollkommen ware, wenn bestimmte rechtlich anerkannte Interessen gegenuber bestimmten Eingriffsformen nicht mit Hilfe der Gewinnabschopfung geschutzt wurden. Hiervon ausgehend entwickelt der Autor eine Gesamtkonzeption, aus der sich schlussig ableiten lasst, auf welche Kriterien es bei der Anwendung der einschlagigen Anspruchsgrundlagen jeweils entscheidend ankommen sollte.
