English summary: In the first part of this study, Patrick Melin describes the modern debate on statutory interpretation in the United States, notably the rise of the so-called 'new textualism', examines its historical roots and political implications and compares the theory and practice of statutory interpretation in the United States with that prevalent in the German legal system. The second part is concerned with the interpretation of international uniform law. The success of unified law is put into question if the national courts applying the law use different approaches to statutory interpretation influenced by their respective legal traditions. Using the CISG as an example, the author develops an autonomous theory of interpretation specifically adapted to international uniform law and examines to what degree courts in the U.S. and in Germany have followed such a theory and been able to avoid a 'homeward-trend' in applying the CISG. German description: Angesichts der zunehmenden internationalen Rechtsvereinheitlichung ist die Beschaftigung mit auslandischen Methodenlehren nicht nur von theoretischem rechtsvergleichenden Interesse, sondern gewinnt immer starker unmittelbar praktische Relevanz. Vor diesem Hintergrund beschaftigt sich Patrick Melin zunachst mit der US-amerikanischen Auslegungsmethode und stellt diese der deutschen rechtsvergleichend gegenuber. Er erlautert die ausserst kontroverse moderne Methodendiskussion in den USA, die bislang in Deutschland kaum rezipiert worden ist, sowie deren politische und historische Hintergrunde. Divergenzen gegenuber kontinentalen Vorstellungen ergeben sich vor allem durch den sogenannten 'new textualism', einer von Supreme Court Justice Scalia vertretenen Lehre, die eine moglichst weitgehende Bindung des Richters an den Gesetzeswortlaut propagiert. Der Autor behandelt anschliessend am Beispiel des CISG die Anwendung internationalen Einheitsrechts. Er beschreibt zunachst eine eigenstandige Methodik der Auslegung und Fortbildung des CISG, die den besonderen Anforderungen des internationalen Einheitsrechts gerecht wird. Dann wird untersucht, inwieweit die bisherige Praxis in Deutschland und den USA vor dem Hintergrund der dargestellten unterschiedlichen nationalen Methodentraditionen diesen Anforderungen gerecht geworden ist.Diese Dissertation wurde von der Universitat Bonn mit dem Preis des Prasidenten der Italienischen Republik ausgezeichnet. Dieser Preis wird jahrlich fur die beste Dissertation der Rechts- und Staatswissenschaftlichen Fakultat vergeben.
