Inhaltsangabe: Einleitung: Um die Zahlungsmoral ist es in Deutschland nicht besonders gut bestellt. Fällige Geldforderungen werden oft Monate lang nicht beglichen, wobei offenstehende Zahlungen häufig unter Berufung auf mögliche Mängel zurückgehalten werden. Ob die gerügten Mängel tatsächlich gegeben sind oder nicht, erfordert dann oftmals eine aufwendige und zeitraubende Prüfung. Besonders bei kleinen und mittelständischen Bauunternehmen und Handwerksbetrieben führt diese zögerliche Zahlungsmoral häufig zu Liquiditätsschwierigkeiten, da diese mit ihren erbrachten bzw. durchgeführten Arbeiten in Vorleistung gehen. Häufig enden Unternehmen vor dem Insolvenzrichter, da sie wegen zu hoher Außenstände ihre Rechnungen (Material-, Personalkosten, etc.) selbst nicht mehr begleichen können und zahlungsunfähig werden. Bei pünktlichem Zahlungseingang wären die Betriebe nicht in diese Misslage geraten. Für die Auftraggeber hingegen ist das Hinauszögern fälliger Zahlungen meist die einzige Möglichkeit, den Auftragnehmer unter Druck zu setzen, um die vertraglich festgeschriebene Leistung mängelfrei und vor allen Dingen termingerecht zu erhalten. Zusätzlich erhalten die Auftraggeber durch das Hinauszögern der Rechnungsbegleichung auf Kosten der Gläubiger zinslose Kredite ( siehe hierzu Verbraucherkreditgesetz (VerbrKrG) § 1 Abs. 2 Satz 1 ) und können so die Geldmittel aus der Zahlungsverzögerung zunächst anderweitig einsetzen. Problemstellung: Um der o.a. Entwicklung entgegenzuwirken, hat der Gesetzgeber bereits seit Anfang der 90er Jahre über Maßnahmen zur Verbesserung der schlechten Zahlungsmoral der Auftraggeber und Bauherren diskutiert. Am 01. Mai 2000 trat das „Gesetz zur Beschleunigung fälliger Zahlungen" in Kraft, welches überwiegend im Bürgerlichen Gesetzbuch (BGB) geregelt ist. Es sieht gesetzliche Maßnahmen vor, die die Verzögerung von Zahlungen für den Schuldner (Auftraggeber) wirtschaftlich erschweren und somit den Gläubigern (Auftragnehmern) eine schnellere Befri
