About the Book

English summary: This volume makes Oskar Bulow's system of the law of civil procedure, a system which had a lasting influence on the modern German law of civil procedure, available to researchers for the first time. Fundamental changes in procedural thinking such as the methodical differentiation between admissibility and justification, the concept of unilateral grounds for beginning litigation proceedings without the real or feigned participation of the defendant and the observance of official res judicata can all be traced back to Oskar Bulow's influence. Since his legacy consists of monographs and essays only and no textbooks, this edition fills a void which had been keenly felt by many. In the introduction, Johann Braun shows how the course Bulow set still influences procedural thinking positively and negatively.
