Zu den Entstehungsbedingungen der Dürrenmattschen Erzählungen dieser Zeit gehört die Lust, aus einem literarischen Elfenbeinturm auszubrechen, der ihn immer mehr zu isolieren droht[e], wie das Vergnügen, die etablierten Erwartungen an Literatur zu provozieren, den Bildungshochmut anzukratzen." Dieser kritischen Einstellung gegenüber der Kriminalliteratur zum Trotz werden Dürrenmatts Kriminalromane "Der Richter und sein Henker" (1951) und "Der Verdacht" (1952) zuerst als Fortsetzungsromane im Schweizer Beobachter publiziert und sind eine wichtige Einnahmequelle für den jungen Dichter. Zwar verweist Dürrenmatt in aller Offenheit in späteren Interviews darauf, dass es seine katastrophale finanzielle Situation gewesen ist, die ihn dazu getrieben hat sich mit dem Kriminalroman zu befassen, doch lässt sich dem Schriftsteller eine gewisse Faszination an der Trivialliteratur nicht absprechen. Weshalb gerade die Kriminalliteratur gegen Ende des 18. Jahrhunderts auf solch breites öffentliches Interesse stößt und damit auch kommerziellen Erfolg verspricht, darauf soll im Verlauf der Arbeit noch näher eingegangen werden. Denn weder die Lust an der Provokation noch die reine ökonomische Notwendigkeit können die Wahl des von Dürrenmatt bevorzugten Genres hinlänglich erklären. Auch lassen sie kaum verständlich werden, dass der Dichter immer wieder in seinem Lebenswerk auf Kriminalliteratur zurückgekommen ist- in dem Roman "Justiz" etwa, dessen Manuskript er bereits 1959 begonnen und erst 1985 abgeschlossen hat. Man kann also nur vermuten, dass es sich hierbei um einen Mischung aus Faszination und einer "...vehementen Abwehr [Dürrenmatts] gegen das Feierliche, gegen den Weihrauch in der
