Studienarbeit aus dem Jahr 2015 im Fachbereich Jura - Zivilrecht / Arbeitsrecht, Note: 11,5, Universität Trier (Schwerpunktbereicht III Arbeits- und Sozialrecht), Veranstaltung: Prüfungsseminar Wintersemester 2015/16, Sprache: Deutsch, Abstract: "Nichts als Lyrik und Chichi", "nichtssagendes Giveaway" oder "unnötige Bürokratie" tönt es bisweilen, wenn von der Erteilung von Arbeitszeugnissen die Rede ist. Keine arbeitsrechtliche Pflicht scheint in der heutigen Zeit mit weniger Interesse erfüllt zu werden, als die Erteilung eines Arbeitszeugnisses. Die vorliegende Arbeit soll aufzeigen, worin dieser Missmut gründet und warum insbesondere Arbeitgeber ein Interesse an der wahrheitsgemäßen Abfassung von Arbeitszeugnissen haben sollten. Im Folgenden werden zunächst die gesetzlichen Grundlagen und der Zweck des Arbeitszeugnisses kurz skizziert (I.). Sodann werden die beiden themenrelevanten Zeugnisarten, das qualifizierte Arbeitszeugnis und das Zwischenzeugnis dargestellt (II.) Hiernach wird der Inhalt dieser Zeugnisse erörtert, wobei insbesondere der Zeugnisgrundsatz der Wahrheit, sein Zusammenwirken mit dem Grundsatz des Wohlwollens und die Bindung des Arbeitgebers an den Zeugnisinhalt tiefere Betrachtung verdienen werden (III.). Den Abschluss des Hauptteils bilden die Ansprüche, die den einzelnen Parteien als auch Dritten bei Vorliegen von Mängeln im Arbeitszeugnis erwachsen. Besonders eingehend wird der Zeugnisberichtigungsanspruch des Arbeitnehmers zu beleuchten sein, da seine Rechtsnatur und die daraus folgenden Grundsätze der Darlegungs- und Beweislast in Rechtsprechung und Literatur unterschiedlichsten Auffassungen begegnen (IV.). Im Fazit werden sodann, unter kritischer Würdigung der jüngsten Rechtsprechung, die Zusammenfassung der Ergebnisse erfolgen und der Versuch einer Lösung unternommen (C.).
