Skript aus dem Jahr 2014 im Fachbereich Jura - Zivilrecht / Arbeitsrecht, Sprache: Deutsch, Abstract: Regelmäßig wird die Frage gestellt, ob Arbeitszeit und Arbeitsentgelt geänderten Bedürfnissen von Arbeitgeber und Arbeitnehmer angepasst werden können. Die Antwort auf diese Frage scheint zunächst einfach. Auch im Arbeitsrecht gilt der Grundsatz, dass bestehende Verträge einzuhalten sind. Grundsätzlich gilt auch für das Arbeitsrecht, dass ein Vertragspartner eine bestehende Vereinbarung nur mit Zustimmung des anderen Vertragspartners ändern darf. Eine Reduzierung von Arbeitszeit und eine Reduzierung von Arbeitsentgelt darf der Arbeitgeber also grundsätzlich nur dann vornehmen, wenn der Arbeitnehmer zustimmt. Auch mit Zustimmung des Arbeitnehmers kann der Arbeitnehmer eine Reduzierung von Entgelt und Arbeitsbedingungen nicht wirksam vornehmen, wenn der Arbeitnehmer dadurch schlechter stehen würde, als dies tariflich geregelt ist. Stimmt der Arbeitnehmer nicht zu, hat der Arbeitgeber bei Vorliegen der Voraussetzungen nur die Möglichkeit eine Beendigungskündigung oder eine Änderungskündigung auszusprechen. Scheitert der Arbeitgeber damit, bleibt es bei den bisherigen Bedingungen. Allerdings haben Arbeitgeber und Arbeitnehmer die Möglichkeit bereits bei Abschluss des Arbeitsvertrages oder bei späteren Vereinbarungen Regelungen vorzusehen, die eine Flexibilisierung von Arbeitszeit und Arbeitsentgelt ermöglichen. Die vorliegende Arbeit soll einen schnellen Einstieg in das Thema ermöglichen.
