Bachelorarbeit aus dem Jahr 2014 im Fachbereich Führung und Personal - Sonstiges, Note: 1,3, Fachhochschule Nordhausen, Veranstaltung: öffentliche Betriebswirtschaft/public Management, Sprache: Deutsch, Abstract: Ein langjährig beschäftigter Leiharbeiter bei demselben Entleiher verklagte sein Aufnahmebetrieb auf eine Übernahme in das normale Arbeitsverhältnis und auf den Ausgleich der Lohndifferenz wegen der nicht mehr vorübergehenden nach §1 Absatz 1 Satz 2 AÜG, sondern dauerhaften, Beschäftigung. (Vgl. BAG 2013) Seiner Klage gab das Landesarbeitsgericht Baden-Württemberg statt. (LAG) (Vgl. LAG 2012) Das Bundesarbeitsgericht (BAG) (Vgl. BAG 2013) lehnte die Klage des Beschäftigten jedoch aufgrund fehlender planwidriger Regelungslücke ab, denn bei vorhandener Überlassungserlaubnis gemäß § 1 Absatz 1 Satz 2 AÜG kein Arbeitsverhältnis zwischen Entleiher und den überlassenen Arbeitnehmer/innen auch bei nicht nur vorübergehender Arbeitnehmerüberlassung begründet wird. (Vgl. BAG 2013, Rn 9 ff.) Die angemessenen und abschreckenden Sanktionen einer nicht mehr vorübergehenden Überlassung kann der deutsche Gesetzgeber, laut der Richtlinie 2008/104/EG, festlegen. (Vgl. BAG 2014, 23) Im Juni 2013 betrug die Zahl der Arbeitnehmer/innen auf Basis der Arbeitnehmerüberlassung 852 Tausend. (Vgl. Bundesagentur für Arbeit 2014, 8) Die Arbeitnehmer/innen verrichten nicht nur die gleiche Arbeit wie die Stammbelegschaft der Einsatzbetriebe, sondern bringen auch häufig hohe Flexibilität und Erfahrung mit. (Vgl. Gutmann/Kilian 2011, 127 f.) Dabei haben sie oft, trotz des Gleichbehandlungsgrundsatzes im Sinne von § 10 Absatz 4 AÜG, nicht zufrieden stellende Arbeitsplatzbedingungen und geringere Bezahlung. (Vgl. Siemund 2013, 246) Die überlassenen Arbeitnehmer/innen erhoffen einen unbefristeten Arbeitsvertrag und die Übernahme in die Einsatzfirma. (Vgl.
