Studienarbeit aus dem Jahr 2014 im Fachbereich Jura - Strafrecht, Note: 13, Philipps-Universität Marburg (Institut für Kriminalwissenschaften), Veranstaltung: Strafrechtliches Seminar: Nationale Verfolgung internationaler Verbrechen, Sprache: Deutsch, Abstract: Im Zentrum der vorliegenden Arbeit steht die Untersuchung der Begründung der Beihilfestrafbarkeit von John Demjanjuk durch das Landgericht München II unter dogmatischen Gesichtspunkten. Dabei wird insbesondere die Entscheidungspraxis deutscher Strafgerichte in früheren NS-Verfahren analysiert. Am 12. Mai 2011 wurde der 91jährige Angeklagte John Demjanjuk von der 1. Strafkammer des Landgerichts München II nach achtzehnmonatiger Hauptverhandlung unter dem Vorsitz von Ralph Alt der sechzehnfachen Beihilfe zum Mord in 28.060 Fällen im NS-Vernichtungslager Sobibor schuldig gesprochen und zu einer Gesamtfreiheitsstrafe von fünf Jahren verurteilt. Unter Berücksichtigung des Alters des Angeklagten hob die Kammer den Haftbefehl gegen Demjanjuk auf, ordnete dessen Entlassung aus der zwei Jahre andauernden Untersuchungshaft an und setzte die Haftvollstreckung unmittelbar aus. Bevor der Bundesgerichtshof über die anhängigen Revisionen des Verurteilten und der Staatsanwaltschaft entscheiden konnte, verstarb John Demjanjuk am 20. März 2012. Das Urteil erlangte somit keine Rechtskraft. Das Urteil der 1. Strafkammer des Landgericht München II, aber auch bereits das Verfahren gegen John Demjanjuk selbst ließen sowohl in vielen Medien, als auch in Teilen der rechtswissenschaftlichen Literatur, kritische Stimmen laut werden. So wurde der Rechtsauffassung der Kammer eine "deutliche Abkehr von der früheren Spruchpraxis" konstatiert. Die Anklage gegen Demjanjuk breche gar mit "mit allem[...] was bislang bei der Ahndung von NS-Verbrechern gegolten hat." Andere wiederum bewerten die Rechtsauffassung des Landgericht München keineswegs als "Paradigmenwechsel bei der Strafverfolgung des Personals in den deutschen Vernichtungslagern"
