English summary: The dispute about the deployment of medium-range missiles in Germany during the 80s triggered a domestic crisis which led to mass blockades of military installations and a conspicuous lack of assurance shown by the highest courts in the country in judging these actions. From the viewpoint of a municipal court judge who was responsible for passing judgment on the blockades in Mutlangen, Werner Offenloch describes these events and his position as a judge. It is his opinion that it is only possible to make legal statements if one remains conscious of the transcendental character of the concept of the law. German description: Im Streit um die Nachrustung der 80er Jahre erlebte die Bundesrepublik Deutschland vor dem Hintergrund einer sich zuspitzenden Konfrontation im Ost-West-Verhaltnis ihre wohl schwerste innenpolitische Krise. Mit Billigung vieler, darunter auch Politiker der Grunen, kam es uber Jahre hinweg an verschiedenen Orten zu zahlreichen Blockaden von Militareinrichtungen durch Nachrustungsgegner. Trotz des Laepple-Urteils des BGH vom Jahr 1969, das in einer Blockade eine Notigung nach 240 StGB gesehen hat, waren sich die Gerichte im Falle der Nachrustungsblockaden zunehmend uber deren Strafbarkeit uneinig, woran auch die mehrmalige Befassung des BGH und des BVerfG mit dieser Frage zunachst nichts anderte - bis schliesslich das BVerfG 1995 mit einer Mehrheit von nur einer Stimme die Bejahung der Strafbarkeit als verfassungswidrig verwarf. Werner Offenloch schildert aus der Sicht eines fur die Blockaden in Mutlangen zustandigen Amtsrichters das teilweise dramatische Geschehen in tatsachlicher und rechtlicher Hinsicht. Der Autor geht davon aus, dass juristische Aussagen nur moglich sind, wenn man sich des transzendentalen Charakters des Begriffs des Rechts, d.h. der Bedingungen seiner Moglichkeit, bewusst bleibt.
