English summary: Based on an authentic case, Georg Werner studies how the rights of a donor to his bodily substances affect a patent which has been or will be issued if the invention leading to the patent is based mainly on the bodily substances of the donor. In order to weigh the rights of the donor against those of the inventor and to put these into proper balance, the author begins by studying the donor's rights to his bodily substances or his genetic information and then the inventor's rights to his patent. He then compares these rights and analyzes the legal consequences for the patent for which an application has been made or which has already been issued. In doing so, he differentiates between the case in which bodily substances have been removed illegally and the case in which these have been made use of without the donor's agreement, and differentiates in his conclusions. German description: Auf einen authentischen Fall gestutzt untersucht Georg Werner, wie sich die Rechte des Spenders an seinen Korpersubstanzen auf ein bereits erteiltes (oder noch zu erteilendes) Patent auswirken, wenn die dem Patent zugrundeliegende Erfindung massgeblich auf Korpersubstanzen des Spenders beruht. Um die Rechte des Spenders mit denen des Erfinders abzuwagen und in Einklang zu bringen, untersucht der Autor zunachst die Rechte des Spenders an seinen Korpersubstanzen oder genetischen Informationen und dann die Rechte des Erfinders hinsichtlich des Patents. Anschliessend stellt Georg Werner diese Rechte einander gegenuber und analysiert die rechtlichen Folgen fur das angemeldete oder bereits erteilte Patent. Dabei sind zwei Situationen zu unterscheiden, in denen die Rechte miteinander kollidieren konnen: Das ist zum einen der Fall, wenn die Korpersubstanzen dem Spender rechtswidrig entnommen wurden. Georg Werner kommt zu dem Ergebnis, dass trotz der gegebenen Verletzung hochstpersonlicher Rechte des Spenders keine hinreichende gesetzliche Grundlage besteht, um die Patentierung zu versagen. Allerdings sieht er den Gesetzgeber in der Pflicht, eine entsprechende Regelung zu treffen. Im zweiten Fall werden die Korpersubstanzen oder genetischen Informationen des Spenders ohne dessen Zustimmung verwertet. Der Verfasser kommt zu dem Ergebnis, dass diese lediglich dann geschutzt sind, wenn sie individuell sind. In diesem Fall fuhrt deren widerrechtliche Verwertung aber auch zur Nichtigkeit des Patents.
