Sodann wird darauf eingegangen, was Location Based Services sind. Ferner wird die Zulässigkeit nach dem TKG und TMG im Verhältnis Arbeitgeber, Telediensteanbieter und TK-Dienstleister erörtert. Weiter wird auf die technischen Voraussetzungen der LBS eingegangen, auf GPS und RFID. Sodann wird auf die rechtliche Zulässigkeit der Einführung kontextbezogener Systeme im Unternehmen eingegangen. Dabei wird zunächst die Legitimierung durch das Betriebsverfassungsrecht erörtert, bevor sodann auf die Legitimierung durch das Datenschutzrecht eingegangen wird. Das Fazit bildet den Abschluss dieser Arbeit. Im Zeitalter der immer weiter entwickelten Technologie werden technische Maßnahmen im Unternehmen immer wichtiger. Vor allem begründen sie aber neue datenschutzrechtliche Risiken. Die Einführung technischer Maßnahmen bedeutet auch immer einen Eingriff in die allgemeinen Persönlichkeitsrechte der Arbeitnehmer. Standortbezogene Dienste werden künftig womöglich vermehrt im Geschäftsleben eingesetzt werden. Darüber hinaus hat das Angebot eine rasante Entwicklung hinter sich, während es im Jahr 2005 noch weniger als 10 LBS-Anbieter waren, sind es im Jahr 2014 schon 927 Anbieter. Die Einführung derartiger Systeme bietet sich für den Arbeitgeber immer dann an, wenn Arbeitnehmer oder Arbeitsmittel nicht standortgebunden sind. Vorteilhaft sind diese Systeme für den Arbeitgeber, da er durch die besseren Koordinationsmöglichkeiten sowohl Zeit als auch Kosten sparen kann. Für den Arbeitnehmer ergeben sich ebenso Vorteile, für ihn bedeutet so ein System eine Arbeitserleichterung, da ein fester Arbeitsplatz nicht mehr notwendig ist und er somit relativ frei ist in seiner Arbeitszeitgestaltung.
